Ayala Defective Seeds, Products Liability Case Headed to a Jury trial Starting June 18th

Ayala’s case where its client claim that they were sold defective seeds is headed to a jury trial starting on June 18, 2021, in the U.S. Central District of California.

The three-and-a-half-year dispute consists of two Peruvian growers who allege that they were sold defective seeds from the defendant which ruined their crops, land, and drastically damaged their businesses and relationships with their customers.

The defendants have argued during the case, among others, that the disclaimers in the seed labels operated as a limitation of liability, and thus, the plaintiff’s damages were limited to the price of the seeds.

The Court was unpersuaded and has ruled priorly that plaintiffs can seek damages beyond the price of the seeds. Now the case is in the fate of a California Jury starting on June 18th, 2021. Stay tuned.
