Ayala Files Class Action Lawsuit Against Marina Palms Residences for Years of Overcharge in Transfer fees

Ayala filed a Class Action lawsuit on behalf of its client against Marina Palms Residence North Condominium Association Inc. (Marina Palms), for overcharging transfer fees during the years.

Under Chapter 718 of the Florida Statutes, condominiums may not charge more than $100 per applicant “in connection with the sale, mortgage, lease, sublease, or other transfer of a unit.” §718.112(2)(I). For many years, Marina Palms has been charging a $125 application fee and a $200 moving fee in direct violation of Florida Statutes §718.112(2)(I).

Marina Palms, a sophisticated high-end complex with hundreds of units, knew or should have known that it was not permitted to charge more than $100 for transfer fees. The Complaint, among others, alleges that the overcharge to hundreds of consumer residents is a violation of the Florida Unfair and Deceptive Practices Act.
