<p><span style="font-weight: 400;">If you have appealed a court decision or are considering whether to appeal, you may have one question that keeps coming up, “What actually happens during an appellate court hearing?”</span></p>
<p><a href="https://www.law.cornell.edu/wex/appeal" target="_blank" rel="noopener"><b>An appea</b></a><span style="font-weight: 400;">l can feel unfamiliar, especially if you have already been through a trial or hearing in the lower court. You may expect to tell your story again, present witnesses, or introduce new evidence. Usually, that is not what an appellate hearing is about.</span></p>
<p><span style="font-weight: 400;">An appellate court generally reviews whether the lower court made a legal error based on the record that already exists. Understanding how the process works can help you know what to expect and, just as importantly, what an appeal can and cannot accomplish.</span></p>
<h4><b>What Is an Appeal in Florida?</b></h4>
<p><span style="font-weight: 400;">An appeal is a request for a higher court to review a decision made by a lower court. In Florida, appeals may involve decisions from circuit courts, county courts, administrative proceedings, and other matters depending on the circumstances.</span></p>
<p><span style="font-weight: 400;">The purpose of an appeal is generally not to retry the entire case. Instead, the appellate court examines the lower court&#8217;s proceedings and determines whether a legal error occurred that affected the outcome.</span></p>
<p><span style="font-weight: 400;">That distinction is important. Winning at trial does not necessarily mean the other side has no further options, and losing does not automatically mean an appeal will succeed.</span></p>
<h4><b>What Happens Before an Appellate Court Hearing?</b></h4>
<p><span style="font-weight: 400;">Much of an appeal happens before anyone appears in front of the appellate judges.</span></p>
<p><span style="font-weight: 400;">The appellate record, briefs, and applicable law are central to the process. The attorneys explain why the lower court&#8217;s decision should be affirmed, reversed, or otherwise modified.</span></p>
<p><span style="font-weight: 400;">Unlike a trial, the appellate process generally does not revolve around calling witnesses and presenting new evidence. Instead, the focus is on the legal issues raised by the appeal.</span></p>
<h4><b>What Does an Appellate Brief Do?</b></h4>
<p><span style="font-weight: 400;">An appellate brief is one of the most important parts of an appeal. It gives the court the legal arguments supporting a party&#8217;s position and explains how the law applies to the issues presented.</span></p>
<p><span style="font-weight: 400;">A strong appellate brief does more than argue that the lower court was &#8220;wrong.&#8221; It identifies the specific alleged error, explains the applicable law, and connects that law to what happened in the underlying case.</span></p>
<h4><b>What Happens During an Appellate Court Hearing?</b></h4>
<p><span style="font-weight: 400;">If the appellate court schedules oral argument, the attorneys appear before a panel of appellate judges. The attorneys typically make legal arguments and answer questions from the judges. The judges may interrupt an attorney to ask about a statute, prior case, procedural issue, or particular fact in the record.</span></p>
<p><span style="font-weight: 400;">This can make appellate oral argument feel very different from a trial. There may be no witnesses. There may be no jury. The attorneys are not simply telling the client&#8217;s story from beginning to end. Instead, they are addressing the legal questions that the appellate court must decide.</span></p>
<h4><b>Do You Have to Speak During an Appeal?</b></h4>
<p><span style="font-weight: 400;">Usually, the attorneys, not the parties, present the arguments during appellate oral argument. If you are the person who filed the appeal or the person defending the lower court&#8217;s decision, you generally will not be asked to take the witness stand and explain what happened.</span></p>
<p><span style="font-weight: 400;">Your appellate attorney&#8217;s job is to present the legal arguments and respond to the court&#8217;s questions.</span></p>
<h4><b>Can You Introduce New Evidence on Appeal?</b></h4>
<p><span style="font-weight: 400;">Generally, an appeal is decided based on the existing record from the lower court. That means you typically cannot use an appeal as an opportunity to introduce evidence that was never presented at trial. This is one reason it is so important to preserve the right evidence and make appropriate arguments in the trial court.</span></p>
<p><a href="https://www.lawayala.com/our-team/"><b>An appellate lawyer</b></a><span style="font-weight: 400;"> therefore needs to understand not only appellate law, but also what happened in the underlying proceeding and what the existing record actually contains.</span></p>
<h4><b>How Long Does an Appellate Court Hearing Last?</b></h4>
<p><span style="font-weight: 400;">There is no single answer. The amount of time allocated for oral argument depends on the court and the particular case.</span></p>
<p><span style="font-weight: 400;">In many appeals, the actual oral argument may be relatively short compared with the amount of work that goes into preparing the briefs, reviewing the record, researching the law, and preparing for questions from the judges. The hearing itself is only one part of the appellate process.</span></p>
<h4><b>What Happens After Oral Argument?</b></h4>
<p><span style="font-weight: 400;">The appellate court does not necessarily announce its decision immediately after the hearing. </span></p>
<p><span style="font-weight: 400;">The judges may take the case under advisement and issue a written decision later. Depending on the outcome, the court may affirm the lower court&#8217;s decision, reverse it, remand the case for further proceedings, or take another action permitted by law. In some cases, further appellate procedures may also be available.</span></p>
<h4><b>Why Is Appellate Litigation Different From Trial Litigation?</b></h4>
<p><span style="font-weight: 400;">Trial litigation and appellate litigation require overlapping but different skills.</span></p>
<p><span style="font-weight: 400;">At trial, an attorney may focus heavily on evidence, witnesses, cross-examination, motions, and presenting a compelling case to a judge or jury. On appeal, the focus shifts toward identifying legal error, interpreting statutes and precedent, analyzing the record, and presenting precise legal arguments.</span></p>
<p><span style="font-weight: 400;">That is why having an attorney who understands appellate procedure can be important when a significant legal issue is at stake.</span></p>

In many situations, the outcome of an appeal can come down to one thing that most people have never even heard of: </span><a href="https://www.law.cornell.edu/wex/standard_of_review" target="_blank" rel="noopener"><b>the standard of review</b></a><span style="font-weight: 400;">.</span></p>
<p><span style="font-weight: 400;">If you are considering filing an appeal in Florida, or defending a judgment that is being appealed, understanding the standard of review is critical. In appellate litigation, the standard of review can heavily influence whether an appellate court gives deference to the trial judge’s decision or takes a completely fresh look at the issue.</span></p>
<p><span style="font-weight: 400;">At our law firm, we regularly handle complex business litigation, real estate litigation, and appellate matters throughout Florida. One thing we often explain to clients is that appeals are not simply “do-overs.” Winning on appeal usually depends on identifying legal errors and framing them under the correct standard of review.</span></p>
<h4><b>What Is a Standard of Review in an Appeal?</b></h4>
<p><span style="font-weight: 400;">A standard of review is the legal framework an appellate court uses when reviewing a lower court’s decision. Different issues are reviewed under different standards. Some standards are very favorable to the party filing the appeal, while others are much harder to overcome.</span></p>
<p><span style="font-weight: 400;">This matters because the appellate court is not retrying the entire case. Instead, the court is deciding whether the trial court made a reversible error. In simple terms, the standard of review determines how much freedom the appellate court has to disagree with the lower court.</span></p>
<h4><b>Why the Standard of Review Can Decide an Appeal</b></h4>
<p><span style="font-weight: 400;">Many appeals are won or lost before oral argument even happens because the standard of review shapes the entire case strategy. For example, if an issue is reviewed “de novo,” the appellate court does not defer to the trial judge’s legal conclusions, they analyze the issue independently, and that can significantly improve the chances of reversing a decision.</span></p>
<p><span style="font-weight: 400;">On the other hand, some issues are reviewed under an “abuse of discretion” standard, which is far more difficult for the appellant. Under that standard, the appellate court gives substantial deference to the trial court’s ruling. This is why experienced appellate attorneys spend significant time analyzing which issues have the strongest review standards before moving forward with an appeal.</span></p>
<h4><b>What Is “De Novo Review” in Florida Appeals?</b></h4>
<p><span style="font-weight: 400;">One of the most favorable standards for appellants is called de novo review.</span></p>

<p><span style="font-weight: 400;">When a Florida appellate court reviews an issue de novo, it gives no deference to the trial court’s legal conclusions. This can be extremely important in business litigation and real estate litigation cases where disputes often center around contracts, legal interpretation, or procedural rulings. If the trial court incorrectly interpreted the law, the appellate court has the authority to reverse the decision without deferring to the lower court’s reasoning.</span></p>
<h4><b>What Does “Abuse of Discretion” Mean on Appeal?</b></h4>
<p><span style="font-weight: 400;">Many clients are surprised to learn that some rulings are much harder to overturn than others. An abuse of discretion standard applies to many procedural and evidentiary rulings. Under this standard, the appellate court generally will not reverse the trial court unless the decision was unreasonable or arbitrary.</span></p>
<p><span style="font-weight: 400;">This often applies to issues involving:</span></p>

<p><span style="font-weight: 400;">These appeals can still succeed, but they typically require a stronger showing that the lower court acted outside the bounds of reasonable judgment.</span></p>
<h4><b>Can You Appeal Because the Judge Got the Facts Wrong?</b></h4>
<p><span style="font-weight: 400;">This is one of the most common questions people search online after losing a case. The answer is: it depends. Appellate courts are generally hesitant to overturn factual findings, especially after bench trials or jury verdicts. Trial judges and juries are given significant deference because they directly observed witness testimony and evidence.</span></p>
<p><span style="font-weight: 400;">However, factual findings can sometimes be challenged if there was insufficient competent evidence supporting the ruling. The key is understanding how the appellate court will review those findings and whether the record supports reversal.</span></p>

<p><span style="font-weight: 400;">When people lose a case in trial court, the first thought is often, “I’ll just appeal.” Appeals sound like a second chance, but the reality is very different. </span><a href="https://www.lawayala.com/common-mistakes-that-tank-appeals/"><b>Most appeals fail</b></a><span style="font-weight: 400;">, not because the losing party didn’t fight hard enough, but because appellate courts are limited in what they can actually review.</span></p>
<p><span style="font-weight: 400;">If you’re considering an appeal in Florida, it’s important to understand the </span><a href="https://www.floridabar.org/the-florida-bar-journal/appellate-standards-of-review/" target="_blank" rel="noopener"><b>standards of review</b></a><span style="font-weight: 400;">, the legal rules that dictate how much leeway appellate judges have to second-guess a trial court’s decision.</span></p>
<h4><b>What Does an Appeal Really Do?</b></h4>
<p><span style="font-weight: 400;">An appeal is not a re-trial. You don’t get to bring in new evidence, call new witnesses, or re-argue your entire case from scratch. Instead, appellate judges review what happened at the trial court to decide whether the judge made an error in applying the law or if there was a serious mistake that affected the outcome.</span></p>
<p><span style="font-weight: 400;">This narrow scope is why so many appeals end in the trial court’s ruling being affirmed.</span></p>
<h4><b>Common Standards of Review in Florida Appeals</b></h4>

<h5><b>1. </b><a href="https://www.law.cornell.edu/wex/de_novo" target="_blank" rel="noopener"><b>De Novo</b></a><b> Review (Fresh Look at the Law)</b></h5>
<p><span style="font-weight: 400;">When an appeal challenges the trial court’s interpretation of the law, appellate judges review the issue from scratch, without deference to the lower court. These appeals have a higher chance of success because they involve pure questions of law.</span></p>
<p><i><span style="font-weight: 400;">Example:</span></i><span style="font-weight: 400;"> If the trial judge misapplied a statute or cited the wrong legal rule.</span></p>
<h5><b>2. Abuse of Discretion (Most Difficult to Overturn)</b></h5>
<p><span style="font-weight: 400;">If the trial judge had discretion, such as in evidentiary rulings, case management, or sentencing, an appellate court will only overturn if the decision was unreasonable or outside the bounds of acceptable choices.</span></p>

<p><span style="font-weight: 400;">This standard is very deferential, meaning even if the appellate judges might have ruled differently, they usually won’t interfere.</span></p>
<h5><b>3. Competent, Substantial Evidence Standard</b></h5>
<p><span style="font-weight: 400;">When the trial court makes factual findings (like deciding which witness was more credible), appellate courts ask whether there was any competent evidence supporting those findings. If there was, even if other evidence pointed the other way, the appellate court will uphold the trial judge’s decision.</span></p>
<p><i><span style="font-weight: 400;">Example:</span></i><span style="font-weight: 400;"> Business partner disputes where testimony conflicts about what was agreed upon.</span></p>
<h4><b>Why Most Appeals Are Unsuccessful</b></h4>
<p><span style="font-weight: 400;">Even with strong arguments, appeals are uphill battles. Here are the main reasons why:</span></p>
<ul>
<li style="font-weight: 400;" aria-level="1"><b>Deference to Trial Courts:</b><span style="font-weight: 400;"> Appellate courts assume the trial judge got it right unless shown otherwise.</span></li>
<li style="font-weight: 400;" aria-level="1"><b>Limited Record:</b><span style="font-weight: 400;"> Appeals are confined to the trial court record. If an argument wasn’t raised below, it usually can’t be raised on appeal.</span></li>
<li style="font-weight: 400;" aria-level="1"><b>Harmless Error Rule:</b><span style="font-weight: 400;"> Even if the trial judge made a mistake, the appellate court may affirm if the error didn’t materially affect the outcome.</span></li>

<h4><b>When Does Filing an Appeal Make Sense?</b></h4>
<p><span style="font-weight: 400;">Appeals can be worthwhile, but only in certain situations. You may have a stronger case for appeal if:</span></p>
<ul>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The trial judge applied the wrong law.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">There was a clear constitutional violation.</span></li>

We’ve seen firsthand how understanding the standard of review can change your legal strategy and your outcome. In this blog post, we’ll break down what it means, how it applies in contract cases, and what Florida business owners need to keep in mind.</p>
<h4 data-start="1066" data-end="1118">What Does “Standard of Review” Mean in a Lawsuit?</h4>
<p data-start="1240" data-end="1492">The standard of review is the legal lens an <a href="https://www.law.cornell.edu/wex/appellate_court" target="_blank" rel="noopener"><strong>appellate court</strong></a> uses to evaluate the decision made by the trial court. In other words, it’s the level of scrutiny the appeals court applies when deciding whether the trial court got it right or wrong.</p>
<p data-start="1494" data-end="1709">Different types of legal issues are reviewed under different standards. Some allow the appellate court to look at everything fresh, while others limit review to whether the lower court abused its discretion.</p>
<p data-start="1711" data-end="1844">So, why does this matter? Because the higher the standard of deference, the harder it is to overturn a trial court’s decision.</p>
<h4 data-start="1851" data-end="1918">What Standard of Review Applies to Contract Disputes in Florida?</h4>
<p data-start="1920" data-end="2167">In Florida, contract interpretation is usually reviewed “<a href="https://www.merriam-webster.com/dictionary/de%20novo" target="_blank" rel="noopener"><strong>de novo</strong></a>” by appellate courts. That means the appeals court looks at the contract and the trial court’s interpretation from scratch, with no deference to what the trial judge decided.</p>
<p data-start="2169" data-end="2190">In plain terms:</p>
<p data-start="2191" data-end="2381">If the dispute centers on what the contract says or means, and there are no factual disputes, the appeals court can form its own opinion without being bound by the trial court’s reasoning.</p>
<p data-start="2383" data-end="2553">This is good news if you lost at trial on a contract issue. It gives your appellate attorney more room to argue the case and convince the court to reconsider the outcome.</p>
<h4 data-start="2560" data-end="2600">When Does a Different Standard Apply?</h4>

<p data-start="3073" data-end="3232">These are much tougher standards to overcome. The appeals court won’t re-weigh the evidence or second-guess the trial judge unless there’s a clear legal error.</p>
<h4 data-start="3239" data-end="3301">How Can the Standard of Review Affect Your Appeal Strategy?</h4>
<p data-start="3303" data-end="3416">Understanding the applicable standard of review is crucial before deciding whether to file an appeal. Here’s why:</p>
<h5 data-start="3418" data-end="3474">1. <strong data-start="3425" data-end="3472">It tells you where your best arguments are.</strong></h5>
<p data-start="3475" data-end="3680">If your case involves contract interpretation, you may have a stronger basis for appeal under the de novo standard. But if it’s based heavily on trial testimony or discretionary rulings, your odds go down.</p>

<p class="p1">Ayala is proud to announce that it has defeated an <a href="https://en.wikipedia.org/wiki/Appeal" target="_blank" rel="noopener">appeal</a> of a <a href="https://en.wikipedia.org/wiki/Trial" target="_blank" rel="noopener">trial</a> victory it obtained last year for its client, an attorney, in a <a href="https://www.law.cornell.edu/wex/breach_of_contract" target="_blank" rel="noopener">breach of contract</a> case.<span class="Apple-converted-space"> </span></p>
<p class="p1">In the case, the Plaintiff alleged that the attorney did not provide the services required under the representation contract. After a bench trial where Ayala’s client was able to show that it performed far more than the hours paid under the agreement, a Broward Circuit Court judge entered judgment in favor of the Ayala’s client.<span class="Apple-converted-space"> </span></p>
<p class="p1">Undeterred, the Plaintiff appealed the judgment to the Fourth District Court of a Appeals.<span class="Apple-converted-space"> </span></p>
<p class="p1">After both parties briefed the issue, the appellate court affirmed, per curiam, the judgment of the trial court.<span class="Apple-converted-space"> </span></p>
<p class="p1">As stated by attorney Eduardo A. Maura: “We are so happy for our client, a decent practitioner who was unfairly sued, and had to go through this litigation for so many years.
