Hybrid clickwrap agreements are internet contracts where consumers are asked to assent by click to an agreement that is available via a hyperlink, which in turn contains itself a hyperlink with an additional agreement.</p>

American Airlines Inc., where two district judges reached opposite conclusions when faced with this hyperlink within hyperlink scenario.</p>

<p class="p1">Ayala filed the first civil rights case in the wake of Mr. George Floyd’s killing and the subsequent societal call to take action against police brutality.</p>
<p class="p1">In the lawsuit, Ayala’s client alleges that during a domestic violence call, members of the Hallandale Police force came to the Plaintiff’s home, entered without a warrant or reasonable suspicion, and beat them inside his own place, dragged him down the stairs violently, smashed his body and face through the police SUV windshield, breaking it, and causing serious injuries. After several hours at the hospital, Plaintiff was not charged with any “domestic violence” count but rather, with “resisting arrest” and “destroying property”—the Police SUV’s windshield.</p>
<p>Ayala filed the lawsuit under Section 1983 of the U.S. Code.</p>

<p class="p1">Ayala law firm, in partnership with Taco Tennis Academy is launching the first edition of the Ayala Open. A open tennis tournament.</p>
<p class="p1">Ayala and Taco Tennis’ owners are long time friends (16 years and counting) both of whom share a passion for tennis. Given their passion, they decided to team up to organize a local tennis tournament that can bring a mix of professional (ATP ranked) amateur, college players; and anyone else that wants to register to play. The goal of the tournament is to grow over the years, but most importantly to create community around tennis. “Our goal is to make a family event where, while enjoying great level of tennis, attendants can at the same time have a great time enjoying play, food, and network,” said Eduardo A. Maura.</p>
<p class="p1">For the first edition, we’ll have the presence of two ATP ranked tennis players: Mr. Junior Ore, currently ranked 617 in the world. Mr. Ore has been ranked as high has 350 in the world. Additionally, we’ll have Mr. Juan Carlos Saez, who is from Chile and has been ranked as high as 230 in the world. The tournament will count with many other high quality pro tennis players.</p>
<p class="p1">The qualifying matches for the main draw took place this week and main draw matches start tomorrow Saturday 26, 2019 at 8:00AM at the facilites of Taco Tennis Academy in Kendall. The transaction included two buildings, one with 6 apartments and another with 7.  The deals were financed by both, Iberia Bank and one of the Sellers. Ayala represented its client in all aspects of the transaction including, negotiations, escrow, financing, and title insurance work.</p>

The lawsuit alleged that Ayala’s client, the buyer of a warehouse in Miami, interfered in the relationship between the Plaintiff/Realtor and the Seller, not present in the case. After prior attempts to get the case dismissed for failure to join the party who actually had to pay the real estate commission, the Seller, the case went to a two day jury trial in which the jury issued a defense verdict.</p>

<p class="p1">Today, May 14, 2019, a Miami Dade Jury entered a verdict in favor of Ayala’s client ruling that its client did not tortuously interfered with the business relationship of the Plaintiff (a realtor) and the Seller of a warehouse property in Miami (the “Property”).</p>
<p class="p1">The lawsuit alleged that Ayala’s client, the buyer of the Property, interfere in the relationship between the Plaintiff/Realtor and the Seller, not present in the case. After prior attempts to get the case dismissed for failure to join the party who actually had to pay the real estate commission, the Seller, the case went to a two day jury trial. As stated by Eduardo A. Maura: “we are extremely happy with the result. We are happy the jury was able to see that this was a lawsuit that admittedly scapegoated our client because the plaintiff could not find the real defendant—the Seller.”</p>
<p class="p1">Ayala’s client will now file a Motion for Attorney’s fees and Cost to recover the cost of having to defend a lawsuit that should have not been pursued in the first place.</p>

(Cross Town).</p>
<p class="p1">In the lawsuit, Ayala’s client allege that at all times he was a lawful resident of Sea Air and authorized to park there. The Complaint also alleges that “[the Plaintiff] did not receive the statutorily required notice of claim of lien on the Subject Vehicle, nor is there any indication that Cross Town ever attempted to give such notice to [Plaintiff]”</p>
<p class="p1">“We keep seeing this abuses by towing companies and associations who casually tow vehicles without following the strict procedures of the Florida Towing Statutes” said Eduardo A. Maura for the firm.</p>

										<content:encoded><![CDATA[<p>Ayala filed a lawsuit in the Miami Dade Circuit Court on Behalf of its client, Names– a prestigious international marine reinsurance brokerage firm with offices in Miami, Madrid and London. The lawsuit alleges that a former partner of Names violated its duties to the company when he, without notice and from one day to the next, destroyed all records of the company computer assigned to him, left the company, and started contacting the company&#8217;s former clients in breach of his fiduciary duties to the company.</p>
<p>In the Complaint, Ayala is seeking an injunction against the defendant ordering the return of the information stolen and prohibiting him from its future use. The complaint also seeks monetary damages caused by checks that the defendant unilaterally wrote to himself as &#8220;vacation&#8221; payments and the damages the company incurred when it could not renew its underwriting membership in one important international syndicate, due to the defendant&#8217;s actions.</p>

<p class="p1">Six years later, we are solid firm. We go against the top firms and lawyers in the world. We litigate class actions and complex commercial matters. We handle complex visa cases and appeals. We handle complex real estate transactions. We try cases by jury.</p>
<p class="p1">Six years later, we are thankful for what we have and even more thankful for the opportunity to practice what we love.</p>
<p class="p1">Six years later, we are extremely thankful for the amazing, loyal clientele we’ve built, that gives us the opportunity and privilege to represent them.</p>
<p class="p1">Six years later we are thankful, and I am thankful, because I look ahead and see nothing but incredible potential, hope, and happiness.
