Florida’s Third District Court of Appeal recently issued a significant decision on contractor work, Incident365 Florida, LLC v. Ocean Pointe V Condo. Ass’n, Inc., 49 Fla. L. Weekly D2004 (Fla. 3d DCA Oct. 2, 2024).

The case revisits the enforceability of contracts involving unlicensed contractors under § 468.8419 of the Florida Statutes.

The case arose from a dispute between Incident365, a mold remediation and disaster recovery company, and several Ocean Pointe Condominium Associations.

Following Hurricane Irma, Incident365 contracted with these associations to provide extensive water and mold damage repair services. However, after an initial disbursement, the condominium associations halted payment, arguing that Incident365 lacked the necessary contractor license to perform many of the contracted tasks, thereby voiding the contract.

In the initial trial, the Monroe County Circuit Court ruled in favor of the associations, aligning with the argument that Incident365’s services required a contractor’s license under Florida law.

The Circuit Court based its decision on definitions found in § 489.105(3)(b), which require licensure for individuals engaged in activities like structural repairs or alterations. However, the Third District Court of Appeal overturned this decision, highlighting that some of Incident365’s activities—such as water extraction, dehumidification, and mold mitigation—do not necessarily fall under activities defined as “contractor” work in the statutory sense.

The court emphasized that categorizing all forms of cleanup and remediation as requiring a contractor license could lead to unintended outcomes, like classifying basic sanitation services as licensed work.

The appellate court’s reversal remanded the case back to the lower court, clarifying that Florida law does not uniformly require a contractor’s license for disaster recovery tasks like mold remediation and water damage repair.

However, the appellate court also pointed out that work involving structural repairs or improvements may still require a license.

This ruling, therefore, underscores the importance of carefully assessing contract language and regulatory requirements for each task to determine licensing needs, especially in hurricane-prone regions where contractors frequently perform recovery work. This decision could shape future licensing-related litigation in Florida, particularly involving claims in the aftermath of natural disasters.

What happens when the plaintiff, who chose the forum, cannot appear in court for their own trial?

First, “[a] written motion by a party to present testimony through communication technology must set forth good cause why the testimony should be allowed in the specific form requested.” Fla. R. Gen. Prac. & Jud. Admin. 2.530(b)(2)(A).

In determining whether “good cause” exists, the court may consider, inter alia, “the consent of the parties, . . . the need and ability to review and identify documents during testimony, . . . the need to observe the demeanor of the witness, the potential for unfair surprise, and any other matter relevant to the request.” Id.

Before, under Fla. R. Gen. Prac. & Jud. Admin. 2.530, “all parties ha[d] an absolute right to prohibit the taking of testimony of a witness by communication equipment.” In re Rules of Judicial Admin., 462 So. 2d 444, 445 (Fla. 1985).

In fact, “a trial court’s discretion to allow testimony to be taken through communication equipment [was] triggered only if all of the parties consent[ed].” Cole v. Cole, 86 So. 3d 1175, 1178 (Fla. 5th DCA 2012); cf. S.A. v. Dep’t of Children & Family Services, 961 So. 2d 1066, 1067 (Fla. 3d DCA 2007) (“Under the rule, trial testimony can be taken by telephone only if all parties consent.”).

Although Rule 2.530 was later amended to give courts discretion in allowing testimony by communication equipment without such consent from all parties, the court must still “consider any objection before authorizing the use of communication technology.” Fla. R. Gen. Prac. & Jud. Admin. 2.530(b).

This is because in our legal system, defendants have a right to confront their accuser face-to-face. See Miller v. Miller, 671 So. 2d 849, 851 (Fla. 5th DCA 1996) (“It is a fundamental right in this country to confront one’s accuser.”). Virtual presence at trial via an image on a screen is not the equivalent of face-to-face confrontation. See Harrell v. State, 709 So. 2d 1364, 1368 (Fla. 1998) (“We are unwilling to develop a per se rule that would allow the vital fabric of physical presence in the trial process to be replaced at any time by an image on a screen.”); Arnold v. State, 358 So. 3d 792, 800 (Fla. 3d DCA 2023) (“Courts have recognized that virtual presence is not equal to physical presence for substantive matters.”).

In a federal context, the Federal Rule of Civil Procedure 43 similarly provides,“For good cause in compelling circumstances and with appropriate safeguards, the court may permit testimony in open court by contemporaneous transmission from a different location.” Fed. R. Civ. P. 43(a).

The notes of the Advisory Committee on Rules further indicate, “The importance of presenting live testimony in court cannot be forgotten. The very ceremony of trial and the presence of the factfinder may exert a powerful force for truth telling. The opportunity to judge the demeanor of a witness face-to-face is accorded great value in our tradition. Transmission cannot be justified merely by showing that it is inconvenient for the witness to attend the trial.”

Fed. R. Civ. P. Adv. Comm. Note Rule 43; See also In re RFC & ResCap Liquidating Tr. Action, 444 F. Supp. 3d 967, 970 (D. Minn. 2020) (“Certain features of testimony useful to evaluating credibility and persuasiveness, such as immediacy of a living person can be lost with video technology, and the ability to observe demeanor, central to the fact-finding process, may be lessened.”).

Notably, a party who could “reasonably foresee the circumstances offered to justify transmission of testimony will have special difficulty in showing good cause and the compelling nature of the circumstances.” Fed. R. Civ. P. Adv. Comm. Note Rule 43.

In summary, although Zoom appearances have become increasingly common, participating in a trial remotely may pose challenges, especially for the plaintiff who selected the given forum. This is further complicated if the plaintiff could have foreseen their inability to travel to the chosen location.

The word “default” in the dictionary simply means the failure to do something required by duty or law.[1] In the legal field, it also means something similar, and it is governed by the Florida Rule of Civil Procedure 1.500.

Rule 1.500 establishes three types of “defaults”: by the clerk (section (a)), by the judge (section (b)), and Final (section (e)). The clerk default is simple. If you were sued and you “failed to file or serve any document” in response, the court’s clerk may enter a default.

A judge’s default occurs when a filed paper is deemed insufficient or inappropriate according to the Florida Rules of Civil Procedure, the Florida Statutes, or a court order. For instance, if a specific rule requires filing an “Answer” to a complaint, and instead, you file a motion seeking different relief, the court may enter a default against you. While the clerk might not take action since a paper was filed, the court, under 1.500 (b), retains the authority to enter a default.

This is now where the “final default judgment” comes in. If the court entered a default against you pursuant to rule 1.500(b), the court may then enter a final judgment of default against you. This is because the initial default may not have specified, for instance, the amount of damages that you will be responsible for. The final judgment will contain the judgment theory, the amount of damages, and any other relief that the court may have ordered.

A default is highly problematic for a litigant. If the litigant has meritorious defenses, the litigant will first, before he or she can assert any defense, revive the case. The steps to revive a default case are not simple and are highly discretionary.
