<p>Ayala is proud to announce that it has reached an $80,000 settlement in a highly contentious 1.5 year old commercial <a href="https://en.wikipedia.org/wiki/Eviction" target="_blank" rel="noopener">eviction</a> case.</p>
<p>The case stems from a lease assigned to Ayala’s client from a prior tenant that the Landlord—the complaint alleged—failed to honor. Despite having approved the new tenant, and taken three months worths of rent payments, the Landlord took it upon itself to eject Ayala’s client by changing the door locks. Thus, from one day to the next, Ayala’s client had to scramble and seek new premises for its machinery rental business, causing substantial damages to Ayala’s business.</p>
<p>After over a year of highly contentious litigation where the defendant took over 10-depositions, and filed innumerous motions, the parties reached an out of court resolution at the mediation conference.</p>
<p>As stated by attorney Eduardo A. Maura: “We are happy with the result, even though it is less than what our client expected. But that is the nature of mediation. Both parties decide to compromise, in an effort to move on and continue with their lives. At the end of the day, that’s what matters the most. Litigation can be brutal.”</p>

										<content:encoded><![CDATA[<p class="p1">In a case that started as a simple eviction for possession, Ayala defeated a multiplicity of unfounded legal challenges by the relentless tenant on the property.</p>
<p class="p1">The tenant/defendant&#8217;s counterclaims included actions for quiet title, cancellation of deed, rescission, mortgage foreclosure and the like. In the latest attempt to stop final judgment the tenant filed an emergency Motion to Set Aside the Final Judgment. Honorable County Court Judge Lawrence D. King gave Ayala less than 24 ours to brief the Court as to why the Motion to Set Aside should be denied. Ayala filed its 20-page brief earlier on March 1, 2017 and after that the Court entered an Order denying defendant’s Motion to Set Aside the Judgment. As stated in the Court’s opinion, “Defendant is simply attempting to rehash the same issues previously considered by [the] Court” and “reargue the same matters.” Order, p.1.</p>
