Section 2(d) of the Trademark Act prohibits the registration of a mark if it closely resembles an already registered mark to the extent that consumers are likely to be confused, mistaken, or misled about the commercial origin of the goods and/or services provided by the parties. See 15 U.S.C. §1052(d). Likelihood of confusion is determined on a case-by-case basis by applying the factors outlined in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).

Any evidence of record related to those factors needs to be considered; however, “not all of the DuPont factors are relevant or of similar weight in every case.” In re Guild Mortg. Co., 912 F.3d 1376, 1379, 129 USPQ2d 1160, 1162 (Fed. Cir. 2019) (quoting In re Dixie Rests., Inc., 105 F.3d 1405, 1406, 41 USPQ2d 1531, 1533 (Fed. Cir. 1997)).

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis: (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services. See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co., 544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

“[C]ontext is critical to a likelihood-of-confusion analysis.” Firebirds Int’l, LLC v. Firebird Restaurant Group, LLC, 397 F.Supp.3d 847, 862 (N.D. Tx. 2019). “The degree of similarity between marks is determined by comparing the marks’ appearance, sound, and meaning. Similarity of appearance is determined on the basis of the total effect of the designation, rather than on a comparison of individual features.” Rex Real Estate I, L.P. v. Rex Real Estate Exchange, Inc., 80 F.4th 607, 622-23 (5th Cir. 2023).

When analyzing the similarity of marks, one should “apply the ‘subjective eyeball test,’ by considering the overall impressions that the marks create, including the sound, appearance, and manner in which they are used,’ rather than comparing isolated features. Furthermore, the mere fact that two marks contain the same word does not, in itself, make the marks substantially similar.” MC3 Investments LLC v. Local Brand, Inc., 661 F.Supp.3d 1145, 1162 (N.D. Fla. 2023) (emphasis added). See Elevate Federal Credit Union v. Elevations Credit Union, 67 F.4th 1058, 1080 (10th Cir. 2023) (holding that there was not a likelihood of confusion between the marks “Elevate Federal Credit Union” and “Elevations Credit Union”); see also Local Brand, Inc., 661 F.Supp.3d at p. 1162.

In trademark law, a letter of protest is a formal document submitted by a third party to the United States Patent and Trademark Office (USPTO). A letter of protest is submitted in accordance with § 1715.01(a) of the Trademark Manual of Examining Procedure (TMEP).

This letter is there to let the USPTO know any relevant information that may affect the registration of a pending trademark application. The purpose of a letter of protest is to ensure that the examining attorney has all the necessary information to make a fully informed decision regarding the trademark application. Here are the key aspects of a letter of protest:

1. Purpose: The primary purpose is to provide evidence or information that the trademark in question should not be registered. This can include evidence of prior use, potential confusion with an existing mark, descriptiveness, or any other reason the trademark might be denied.
2.  Timing: A letter of protest must be submitted before the mark is published for opposition. Once the mark is published, any objections must be raised through a formal opposition proceeding.
3. Content: The letter should contain relevant evidence and a clear, concise explanation of why the trademark should not be registered. This can include examples of existing trademarks that might be confused with the new application, descriptions of the goods/services involved, or evidence of the mark being generic or descriptive.
4. Evaluation: The USPTO will review the letter of protest to determine if the evidence presented is relevant and significant enough to consider. If accepted, the examining attorney will review the information when deciding on the trademark application.
5. Impact: If the letter of protest is successful, it can lead to the refusal of the trademark application or at least a significant delay while the issues raised are considered. However, the third party submitting the letter does not become a party to the proceedings, and does not have further involvement, unless they choose to file a formal opposition later.

Overall, a letter of protest is a useful tool for third parties to influence the trademark registration process without initiating formal legal action.

A trademark is a type of intellectual property consisting of a recognizable design that identifies your product or service, and distinguishes it from other products or services.

Trademark law is primarily regulated by the Lanham (Trademark) Act under 15 U.S.C. § 1051 et seq. In accordance with this Act, interpreting regulations and relevant court decisions, the United States Patent and Trademark Office (USPTO) allows businesses and individuals to register their marks.

Once registered, this mark registration serves as “prima facie” evidence of the mark’s validity. Jack Daniel’s Properties, Inc. v. VIP Products LLC, 599 U.S. 140, 147 (2023). However, this does not mean that non-registered marks cannot be enforced. It is also well settled that the “owner of even an unregistered trademark can ‘use [the mark] in commerce and enforce it against infringers.’” Id.

When suing to prohibit someone from using your business mark, the court “must decide whether the defendant’s use is ‘likely to cause confusion, or to cause mistake, or to deceive.’” Id.

The ‘“keystone” in that statutory standard is the “likelihood of confusion.” “And the single type of confusion most common in trademark law’s sights is confusion ‘about the source of a product or service.'” Moseley v. V Secret Catalogue, Inc., 537 U.S. 418, 428, 123 S.Ct. 1115, 155 L.Ed.2d 1 (2003).

Therefore, lack of registration does not bar a business owner from enforcing competing use of a mark. However, it is highly recommended that marks be registered. An approved registration will create a “prima facie” (a presumption) case that the mark is valid and that it is not competing (or was not, at the time it was registered) with other marks.

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that was enacted in 1998. It’s purpose is to address the challenges posed to copyright owners, content creators, and online service providers by digital technologies. The DMCA consists of five main titles, each addressing different aspects related to copyright protection and digital technologies. Here’s a brief overview of the key provisions:

Title I – WIPO Copyright and Performances and Phonograms Treaties Implementation Act 

This section implements the obligations of the United States under the World Intellectual Property Organization (WIPO) Copyright Treaty and WIPO Performances and Phonograms Treaty.

Title II – Online Copyright Infringement Liability Limitation Act (OCILLA)

This section offers a safe harbor for online service providers (OSPs) such as Facebook, Instagram, or Twitter/X from copyright infringement liability arising from the actions of their users. OSPs must adhere to specific procedures outlined in the DMCA, including promptly removing infringing content upon receipt of a valid takedown notice from a copyright owner.

Title III – Computer Maintenance Competition Assurance Act

Here, issues related to computer maintenance activities and the circumvention of technological protection measures are addressed.

Title IV – Miscellaneous Provision 

This section contains various miscellaneous provisions, including provisions related to the use of certain works for distance education, the effect of the DMCA on other laws, and database protection.

Title V – Vessel Hull Design Protection Act 

Title V offers protection for vessel hull designs. One of the most recognized aspects of the DMCA is the safe harbor provision in Title II, shielding online service providers from liability for copyright infringement committed by their users if they meet certain conditions. The DMCA also introduced the concept of notice and takedown, enabling copyright owners to request the removal of infringing content from online platforms.

By far the most used aspect of the DMCA is that it is the framework by which copyright holders can notify online service providers that their sites are hosting or providing access to allegedly infringing material. See Na’l Acad. of Television Arts & Scis., Inc. v. Multimedia Sys. Design, Inc., 551 F. Supp. 3d 408, 432 (S.D.N.Y. 2021).

Those reporting infringing activity have to be careful because the DMCA prohibits “any person” from “knowingly materially misrepresent[ing] … that material or activity is infringing.” 17 U.S.C. § 512(f)(1). However, when copyright holders request that an allegedly infringing video be removed, they are “not liable for misrepresentation under the DMCA if they subjectively believe the identified material infringes their copyright, even if that belief is ultimately mistaken.” Hosseinzadeh, 276 F. Supp. 3d at 44.

In this context, a copyright holder “must have actual knowledge that it is making a misrepresentation of fact” to be liable under § 512(f). Cabell v. Zimmerman, No. 09-CV-10134, 2010 WL 996007, at *4 (S.D.N.Y. Mar. 12, 2010) (emphasis in original); see also Rossi v. Motion Picture Ass’n of Am. Inc., 391 F.3d 1000, 1005 (9th Cir. 2004) (“[T]here must be a demonstration of some actual knowledge of misrepresentation on the part of the copyright owner.”). Nat’l Acad. of Television Arts & Scis., Inc. v. Multimedia Sys. Design, Inc., 551 F. Supp. 3d 408, 432 (S.D.N.Y. 2021)
