<p class="p1">Ayala defeated the Defendant Corona Seeds’ Motion for Summary Judgement (MSJ). An MSJ is a request to the court in which the party moving argues that there are no factual issues in dispute, and the judge, rather than the jury, should decide the case in its favor.</p>
<p class="p1">In the case, Ayala’s clients, two Peruvian growers, allege that they were sold defective seeds from the defendant which ruined their crops, land, and drastically damaged their businesses and relationships with their customers.</p>
<p class="p1">In the MSJ defendant Corona argued, among others, that the disclaimers in the seed labels operated as a limitation of liability and thus, plaintiffs damages were limited to the price of the seeds. The Court was unpersuaded and ruled that plaintiffs can seek damages beyond the price of the seeds. The case now advances to trial in April of 2020.</p>
