Ayala Law Successfully Recovers Client’s Vehicle in Wrongful Lien Lawsuit

We’re happy to announce that our attorney, Ryan Sawal, Esq., has successfully resolved an ongoing dispute between our client and a towing company which, as alleged in the complaint, wrongfully removed and claimed title to their vehicle, despite failing to provide proper notice.

The lawsuit, which involved claims of civil theft and violation of § 713.78, Fla. Stat., was resolved through a full settlement, including the return of the vehicle to our client.

Regarding the result, attorney Sawal stated, “A priority in this case from the beginning was getting the vehicle back for our client as soon as possible. We are happy to have been able to accomplish that in the early phases of this case, and while also saving our client much of the legal fees involved in a protracted litigation.”

In plain terms:

Did the parties orally modify the agreement?

And unfortunately, many appeals are lost before they even begin, not because the legal arguments are weak, but because of avoidable procedural mistakes.

Whether you’re a business owner, property investor, or individual litigant thinking about appealing a court decision, knowing these pitfalls can save you time, money, and a potential loss.

What Can Go Wrong Before an Appeal Even Begins?

The appellate process isn’t just about right or wrong, it’s also about following rules and deadlines to the letter. Here’s where things often go off track.

1. Missing the Deadline to File a Notice of Appeal

How long do I have to file an appeal in Florida?

The most common, and most unforgiving, mistake is missing the deadline to file your Notice of Appeal. In most Florida civil cases, you have 30 days from the date the final judgment is rendered.

This deadline is strict, there are no extensions. If you miss it, your right to appeal is gone. No matter how strong your argument might be, the court won’t hear it.

2. Appealing a Non-Final or Non-Appealable Order

Can I appeal a court order that isn’t final?

Not every court order can be appealed. Many litigants try to challenge decisions that are not final judgments or don’t qualify for immediate appeal under Florida law. This leads to wasted effort and, often, a dismissal.

Understanding what is appealable and what isn’t requires knowledge of Florida’s appellate rules. Appealing the wrong type of order can delay your case and damage your credibility with the court.

3. Failing to Preserve Issues for Appeal at Trial

What does it mean to preserve an issue for appeal?

If you’ve recently lost a case, or received a judgment you’re unhappy with, you might be wondering, “Can I appeal this decision?”

It’s a reasonable question, and as Florida litigation attorneys, it’s one we get often. The reality is, not every decision from a trial court is immediately appealable, and not every disagreement with a judge’s ruling means you have the legal grounds for an appeal.

In this blog post, we’ll break down the basics of what makes a trial court decision appealable in Florida, when you can appeal, and how the process works. We’ll do it in plain English, so you can understand your options and make informed next steps—whether you’re a business owner, property holder, or individual involved in civil litigation.

What Is an Appeal in Florida Civil Court?

An appeal is a legal process where a higher court reviews a decision made by a lower (trial) court. The goal is not to re-argue your case or introduce new evidence. Instead, the appellate court looks at the record of what happened in the trial court and decides whether the law was applied correctly.

If you believe the judge made a legal error, appealing may be appropriate, but it has to meet certain criteria.

Can You Appeal Any Trial Court Decision?

What Are Some Examples of Appealable Issues?

Even if you have a final judgment, that doesn’t mean an appellate court will reverse it. To succeed on appeal, you usually need to show that the trial court made a legal error that affected the outcome.

Here are some common examples of appealable errors:

The judge applied the wrong legal standard
Evidence was improperly admitted or excluded
The court misunderstood or misinterpreted the law
The court ruled on an issue that wasn’t properly raised

Can You Appeal a Non-Final Order in Florida?

What’s the Process for Appealing a Trial Court Decision?

The Florida appellate process generally follows these steps:

Notice of Appeal: Filed within 30 days to alert the court and parties.
Record on Appeal: The trial court’s transcript, evidence, and rulings are sent to the appellate court.
Written Briefs: Both sides submit legal arguments. This is the core of the appeal.
Oral Argument (sometimes): The lawyers may appear before a panel of judges to argue the case in person.
Appellate Decision: The court issues a written opinion—either affirming, reversing, or modifying the lower court’s decision.

Ayala Obtains $85,000 Global Settlement in Against Miami Towing Company that Towed and Sold its Client’s Vehicles

Ayala is happy to share that it has obtained an $85,000 global settlement against a Miami towing company that towed and sold its clients’ vehicles.

The case involved the tow of two different vehicles from two different apartment complexes in Kendal by the same towing company. Even though both of Ayala’s clients were legal residents of the building, the towing company towed both vehicles. Not content with that, the towing company refused to return the vehicle to Ayala’s clients who were willing and able to pay the towing charges.

In one of the cases, Ayala’s client went as far as going to the “auction sale” and bid on their own vehicle. But the towing company did not allow Ayala’s client to bid on their own vehicle, saying the sale was over some five minutes after it opened.

As stated by attorney Eduardo A. Maura, “’Corrupt practices’ is an understatement. What these towing companies get away with is beyond belief. We are happy that, after a year litigating these companion cases, we were able to obtain our clients the full value of their vehicles.”

Attorney Ryan Sawal, who also litigated the case, stated, “We and our clients are very happy with the result. This is the result of not only a team effort, but of us building a strong lien law litigation practice. It is fair to say that we are experts in this area.”

Miami Judge Grants Motion to Claim Punitive Damages Against Regulated Towing for Selling & Keeping the Proceeds of Ayala’s Client’s Vehicle

Ayala is happy to announce that it has obtained an order granting its motion for leave to amend a complaint seeking to add a claim for punitive damages against Regulated Towing Inc., a Miami towing company. The case involves the towing of Ayala’s client from their own apartment and then, the subsequent sale of the vehicle in a sham auction.

During the case’s discovery phase, where litigants are allowed to gather evidence, Ayala’s lawyers uncovered proof of its client’s repeated request to halt the vehicle’s sale. Ayala’s client even requested to bid on his own vehicle. However, the owner and agent of Regulated Towing, Mr. Michael Fasano, fabricated numerous arbitrary requirements to prevent the client from doing so, even though this was a vehicle that should have been promptly returned to the client upon payment of the outstanding invoice.

The arbitrary requirements to bid on his own vehicle included a demand for the client to prove availability of cash equivalent to the vehicle’s value, which Mr. Fasano arbitrarily stated was $20,000; a requirement not present on any statute or regulation.

Given these facts, Ayala filed a motion for leave to amend its complaint and seek a claim for punitive damages. Under the Florida Rule of Civil Procedure 1.190, litigants have to obtain consent from the court to seek a claim for punitive damages.

On July 16, 2024, Honorable Judge Charles Johnson of the 11th Circuit Court in Miami, Florida, granted Ayala’s motion.

As stated by attorney Ryan Sawal, “We are happy that the court agreed with us. The court understands our claims and saw that, at a minimum, this is a case where a claim for punitive damages should go forward.” Attorney Eduardo Ayala Maura similarly stated, “This is a step in the right direction. Nobody holds towing companies accountable. They are running an entire sale-of-vehicles operation, and nobody is doing anything about it. We are glad that we at least can use our litigation expertise to make them pay.”
