<p class="p1">Ayala is proud to announce that it has obtained a $75,000 settlement in a case where Ayala’s client alleged that the <a href="https://www.law.cornell.edu/wex/negligence" target="_blank" rel="noopener">negligence</a> of the condominium association caused its client serious injuries.<span class="Apple-converted-space"> </span></p>
<p class="p1">The complaint in the case alleged that the defendant left a door access to the condo garage in disrepair for months, if not years. The failure to repair it, despite having knowledge of the condition, caused serious injuries to its client’s ankle.</p>
<p class="p1">The case was litigated for nearly a year an a half, and was on the eve of a <a href="https://en.wikipedia.org/wiki/Jury_trial#:~:text=A%20jury%20trial%2C%20or%20trial,of%20judges%20makes%20all%20decisions." target="_blank" rel="noopener">jury trial</a> set to start the last week of March.<span class="Apple-converted-space"> </span></p>
<p class="p1">As stated by attorney Eduardo A. Maura:</p>
<p class="p1">“We are happy with the result. Though our client had to wait over a year and a half to obtain the right compensation, we are happy that we finally achieved that. Though we are always trial-ready, we always want to obtain the best results for our clients, with the least resources and time possible. In that context, we are happy that we were able to obtain a good settlement pre trial, and avoid the inherent uncertainties that a trial bring.”</p>

<p class="p1">The Daily Business Review discussed Ayala’s Jury Trial win for its client. The lawsuit alleged that Ayala’s client, the buyer of a warehouse in Miami, interfered in the relationship between the Plaintiff/Realtor and the Seller, not present in the case. After prior attempts to get the case dismissed for failure to join the party who actually had to pay the real estate commission, the Seller, the case went to a two day jury trial in which the jury issued a defense verdict.</p>

<p class="p1">Today, May 14, 2019, a Miami Dade Jury entered a verdict in favor of Ayala’s client ruling that its client did not tortuously interfered with the business relationship of the Plaintiff (a realtor) and the Seller of a warehouse property in Miami (the “Property”).</p>
<p class="p1">The lawsuit alleged that Ayala’s client, the buyer of the Property, interfere in the relationship between the Plaintiff/Realtor and the Seller, not present in the case. After prior attempts to get the case dismissed for failure to join the party who actually had to pay the real estate commission, the Seller, the case went to a two day jury trial. As stated by Eduardo A. Maura: “we are extremely happy with the result. We are happy the jury was able to see that this was a lawsuit that admittedly scapegoated our client because the plaintiff could not find the real defendant—the Seller.”</p>
<p class="p1">Ayala’s client will now file a Motion for Attorney’s fees and Cost to recover the cost of having to defend a lawsuit that should have not been pursued in the first place.</p>

(Cross Town).</p>
<p class="p1">In the lawsuit, Ayala’s client allege that at all times he was a lawful resident of Sea Air and authorized to park there. The Complaint also alleges that “[the Plaintiff] did not receive the statutorily required notice of claim of lien on the Subject Vehicle, nor is there any indication that Cross Town ever attempted to give such notice to [Plaintiff]”</p>
<p class="p1">“We keep seeing this abuses by towing companies and associations who casually tow vehicles without following the strict procedures of the Florida Towing Statutes” said Eduardo A. Maura for the firm.</p>

<p class="p1">Six years later, we are thankful for what we have and even more thankful for the opportunity to practice what we love.</p>

										<content:encoded><![CDATA[<p class="p1">After nearly two years of contentious litigation, Ayala’s case on behalf of its client, a Miami Medical Center, is set for jury trial in August 2019.</p>
<p class="p1">In the case, Ayala’s client claims that the defendant, wrongfully terminated its contract with it, under bogus allegations of violations of the law, in an effort to transfer Ayala’s client’s patients to other friend-centers of (or in association with) the Defendant.</p>
<p class="p1">As stated by attorney Eduardo A. Maura, “we are happy that a jury will finally hear our side of the story and we are confident that when they hear the defense’s inconsistent positions, the jury will side with us.”</p>

										<content:encoded><![CDATA[<p class="p1">The Daily Business Review discussed the Jury Verdict Ayala obtained in favor of its Venezuelan client.</p>
<p class="p1">Ayala represented the plaintiff, a Venezuelan immigrant investor, who under the promise of a phony development deal paid for the purchase price of a land contiguous to land already own by the defendant. In reliance of the promise to build warehouses in the newly acquired land (and a portion of the land already owned by the defendant) the plaintiff allowed the defendant to be in the title of the land. Soon after closing the defendant knocked down the fence separating both lands, did nothing to build any warehouse, and effectively enlarged its existing land and business.</p>
<p class="p1">After a 5 day Jury Trial, the jury awarded Ayala’s client the land (valued conservatively at $517,000) and $84,000 in back rent for the time the Defendants used the land.</p>
