Maura · Published October 20, 2026

A temporary injunction is an early court order. It tells a party to stop a specific act, or to keep things as they are, while the lawsuit is pending. Business owners in Tampa, Hillsborough County and the wider Tampa Bay area often look at this tool when a partner or vendor is causing harm now. Waiting months for a final judgment can leave a company exposed. This page explains how the order works, what a court looks at, how the bond rule works, and what to do next.

What a Temporary Injunction Is and Who It Helps

A temporary injunction stops or preserves conduct early in a lawsuit, before the court decides who is right. Money damages pay for harm that already happened. An injunction deals with harm that is happening now or is threatened.

It often fits situations like these:

A partner who is moving customers to a new company.

This statute governs enforcement of restrictive covenants, so a vendor that refuses to deliver goods or services the contract requires is not covered by it unless the contract contains a restrictive covenant.

A former partner or employee who is misusing confidential business information.

The order is interim. It doesn’t decide whether the contract was breached. That question goes to the final ruling.

Florida’s restrictive covenant statute recognizes this remedy. It says a court shall enforce a restrictive covenant by any appropriate and effective remedy, including temporary and permanent injunctions. Fla. Stat. § 542.335 covers restrictive covenants, the promises that limit competition. That makes it most relevant when a former partner or employee is competing.

If a partner or vendor is harming your company right now, you don't have to work out the next step alone; our team can talk through your contract and the conduct with you. The judge looks at the record the requesting party presents. In contract disputes, that record often includes the contract, messages showing the breach, and proof of ongoing harm.

Common situations include:

Threatened misuse of trade secrets or customer lists.

A vendor withholding a product or service the business depends on.

A partner locking the company out of bank accounts or business software.

A sale or transfer of disputed business assets.

An emergency order works differently. It is requested and entered before the other side has a hearing. Courts reserve these for cases where waiting would cause harm that can’t be undone. A hearing with notice to the other side usually follows.

What You Must Prove to Get a Temporary Injunction

In general, the party asking for the order must show a legal right to relief.

The contract, the obligation at issue, and an actual or threatened breach.

Harm that damages would not adequately repair, such as lost customers or goodwill.

Restrictive covenants have extra rules. The covenant must be in a writing signed by the person against whom enforcement is sought. The party seeking enforcement must prove a legitimate business interest, such as trade secrets or substantial customer relationships. It must also prove the restraint is reasonably necessary to protect that interest. Fla. Stat. § 542.335 says a court shall modify an overbroad restraint, not enforce it as written.

The bond rule is strict in these cases. No temporary injunction can be entered unless the party seeking it gives a proper bond. Fla. Stat. § 542.335 reads: “No temporary injunction shall be entered unless the person seeking enforcement of a restrictive covenant gives a proper bond, and the court shall not enforce any contractual provision waiving the requirement of an injunction bond or limiting the amount of such bond.” A contract clause that waives the bond or caps its amount can’t be enforced.

Document early. Gather the signed contract, emails, dates of the breach, and proof of ongoing harm before you file. Weak facts can also create risk.

Temporary, Preliminary, and Permanent Injunctions Compared

A temporary injunction is the early order. A permanent injunction is the final order that comes with a judgment. The labels are easy to mix up, so check the court’s wording.

Temporary: entered early and in effect until a later ruling or judgment.

Preliminary: often used as a near-synonym for temporary. Confirm which label the court uses in its order.

Permanent: final, entered after the merits are decided.

Florida’s restrictive covenant statute names both temporary and permanent injunctions as enforcement tools.

The practical point is simple. A temporary order gives short-term protection. A permanent order is the end result if the business prevails on the contract claim. Nothing about the early order tells you how the final ruling will come out.

What an Order Can Cover in a Partner or Vendor Dispute

An order can stop a party from doing something. It can also require a party to keep performing, as long as its terms are specific.

Stop a current or former partner from soliciting customers, employees, or vendors in breach of a written agreement.

Require a vendor to keep supplying goods or services under the contract while the case goes forward, where the court finds that appropriate.

Prohibit use or disclosure of confidential business information.

Freeze transfers of disputed assets, accounts, or property.

Require preservation of records, emails, and accounting files.

Scope matters. A vague order is hard to follow and hard to enforce. Each side should be able to tell what compliance looks like. For restrictive covenants, a court that finds a restraint overbroad, overlong, or otherwise not reasonably necessary to protect a legitimate business interest shall modify the restraint and grant only the relief reasonably necessary to protect that interest. Fla. For a Tampa Bay business, that can point to Hillsborough County, depending on the facts.

Check the contract for an arbitration clause. If one applies, a party can ask the court to order arbitration. Fla.
