Maura · Published October 26, 2026

Is $400 an hour a lot for a lawyer? By itself, the number doesn’t tell you much. An hourly rate is the price of one hour of a lawyer’s billed time. Your total bill depends on how many hours the dispute takes and what other costs come with it.

This page explains what that rate covers in a business dispute, how billing works, and what drives the total. It is written for business owners, managers, and entrepreneurs weighing the cost of counsel. Eduardo A. Maura is the responsible lawyer for this page. Ayala Law PA focuses on business litigation in Florida courts and arbitration.

What $400 an hour means in practice

An hourly rate is the price for one hour of lawyer time spent on your matter. It is not the lawyer’s take-home pay. Think of the rate as one input. The others are the hours worked and any costs billed on top of the fee.

Two matters at the same rate can cost very different amounts. A dispute that needs 10 hours of work and one that needs 150 hours will produce very different bills. Whether $400 is a lot for your situation depends on the facts of your dispute and your budget.

For an overview of the practice areas, see our business litigation overview.

Why the hourly rate is not a lawyer’s paycheck

A rate pays for the lawyer’s time and the cost of running a practice. Overhead includes office space, support staff, insurance, technology, and research tools. Florida’s fee rule says general overhead should be accounted for in a lawyer’s fee, whether the fee is hourly, flat, or contingent (Florida Bar Rule 4-1.5).

Not every hour a lawyer works is billed to a client. Firm administration and marketing are not work done for a particular client, so they are not billed to one. When you compare rates, keep this gap in mind.

How hourly billing works in a commercial dispute

Hourly billing records time in small blocks, often tenths of an hour, and charges for each entry. A monthly invoice should list each entry clearly. Check four things on every entry: the date, the task, who did the work, and the time spent.

Support staff, such as assistants and office staff, often handle scheduling, filings, and document organization. Whether their time is billed separately or built into the rate depends on your engagement terms. Ask about this before you sign.

Put the rate, billing practices, and any retainer terms in a written engagement agreement. In contingent fee cases, Florida’s rules require the lawyer to give the client a statement of rights, including the right to receive and approve a closing statement at the end of the case before paying any money (Florida Bar Rule 4-1.5).

What drives the total cost of a business lawsuit or arbitration

Total cost follows the work the case requires. Complex claims take more hours. A shareholder dispute with several parties, a construction lien foreclosure, or an international trade dispute with documents from abroad can each require extended document review and coordination.

Hours add up in discovery, depositions, motions, mediation, and hearings. Florida law requires a court to send a filed civil action for money damages to mediation when one party asks, if that party can pay or the costs can be divided, with listed exceptions (Fla. Stat. 44.102). Fla. Stat. § 44.102 reads: “(2) A court, under rules adopted by the Supreme Court: (a) Must, upon request of one party, refer to mediation any filed civil action for monetary damages, provided the requesting party is willing and able to pay the costs of the mediation or the costs can be equitably divided between the parties, unless: 1.” Mediation can add time and cost to the path of a case.

Written arbitration agreements also matter. Under Florida law, an agreement in a record to arbitrate a controversy is generally valid and enforceable (Fla. Stat. 682.02). Fla. Stat. § 682.02 reads: “(1) An agreement contained in a record to submit to arbitration any existing or subsequent controversy arising between the parties to the agreement is valid, enforceable, and irrevocable except upon a ground that exists at law or in equity for the revocation of a contract.”

Costs beyond the fee also add up. Filing fees, transcription, and similar charges are billed to the client at the actual amount paid by the lawyer, separate from overhead (Florida Bar Rule 4-1.5). Expect charges for service of process, court reporters, and fees for third-party witnesses or records. Timing also depends on the court calendar and the other side’s conduct. See how long commercial litigation takes.

How to decide whether the rate fits your situation

Compare three things: the amount in dispute, the cost of the lawyer’s time, and the business result you need to protect. A rate that looks high can still be reasonable for a large dispute, and a modest rate can be costly on a long one.

Fee structures differ. Hourly billing fits matters where the work is hard to predict. A flat fee can suit defined tasks. Not every matter fits every structure.

Ask these questions at intake:
– What does the rate include?
– How is time recorded?
– Which costs are billed separately?
– How often will I receive invoices and updates?

Common questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does an hourly rate include court costs?

Not usually. Filing fees and transcripts are charged to the client separately.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is hourly billing better than a flat fee?

Neither is better for every case. The right structure depends on the matter.

Where a case is filed also matters. Under Florida’s venue statute, actions shall be brought only in the county where the defendant resides, where the cause of action accrued, or where the property in litigation is located; this section does not apply to actions against nonresidents.
