For a Plant City business, that might mean an unpaid invoice, a supplier that missed deliveries, or a landlord who won’t make repairs. Many disputes can be worked out early, but deadlines and paperwork matter from day one. This page explains how these disputes usually develop and how they move toward resolution in Florida. It is general information, not advice about your situation. Ayala Law PA focuses on business and commercial litigation, including contract disputes. Clients in Plant City and Hillsborough County are served from the firm’s only office, in Tampa.

What Counts as a Contract Dispute for a Plant City Business

A contract dispute is a disagreement over whether a party kept its promises under an agreement. The deal can be written or oral, and it can be a formal contract or a simple purchase order. Common examples include an unpaid invoice for materials delivered to a job site, a customer who refuses goods, a vendor who misses delivery dates, or a fight over payment milestones on a service job. These problems show up in agriculture-linked supply, trades, hauling, distribution, and service businesses. Many owners assume an informal deal carries no legal weight, and that is often wrong. For goods priced at $500 or more, a contract is generally not enforceable unless a signed record exists, with listed exceptions, under Fla. Stat. § 672.201. Florida’s deadline rules also treat oral and written contracts differently, which is covered below.

If a customer has stopped paying or a vendor has stopped delivering, our team can review your contract and records with you, so reach out to book a case evaluation. No general answer fits every case, and no lawyer can promise a particular result. The hurdles that come up most often are missing records, unclear numbers, and contract clauses that limit recovery. Timing is another one. Florida law generally treats a contract term that shortens the deadline to sue as unenforceable under Fla. Stat. § 95.03, but contracts for the sale of goods are an exception, since Fla. Stat. § 672.725(1) allows the parties to reduce the limitations period to not less than one year. Under Fla. Stat. § 95.031, a claim accrues when its last element occurs, so note the date of each breach.

Steps to Take Before Sending a Demand Letter

Gather your records before you write anything, then decide what the letter should accomplish. A demand letter states your claim, the payment or action you want, and a date for a response. It can open talks, but it also becomes a document the other side can use. Start with the contract and every amendment. Add invoices, purchase orders, delivery tickets, emails, texts, photos, and a full payment history. Write a short timeline with dates. When you have accepted goods, Fla. Stat. § 672.607 requires notice of breach within a reasonable time after you discover it, or you may be barred from any remedy. Then review what the letter should avoid: admissions of fault, threats you cannot back up, insults, and figures that don’t match your records. Keep track of the deadlines above while you negotiate.

How Contract Disputes Get Resolved in Florida

Most contract disputes move from talks, to a written demand, to mediation, arbitration, or a lawsuit, and many settle before trial. In a filed civil action for money damages, Fla. Stat. § 44.102 requires a court to refer the case to mediation when one party asks, unless an exception applies. Exceptions include a suit filed to collect a debt and a case where the parties agreed to binding arbitration. A written agreement to arbitrate is generally enforceable under Fla. Stat. § 682.02. Under Fla. Stat. § 682.03, a court cannot refuse arbitration because the claim lacks merit. Settlement offers carry deadlines too. Under Fla. Stat. § 768.79 and Fla. R. Civ. P. 1.442, a written offer of judgment or settlement generally stays open for 30 days unless withdrawn. Where you file also matters. Under Fla. Stat. § 47.011, suit must be brought where the defendant resides, where the claim accrued, or where the property is located. A Plant City dispute may therefore land in Hillsborough County, depending on the facts.

Plant City Contract Disputes Involving Construction, Leases, and Owners

Construction, lease, and owner disputes are common in Plant City, and they often overlap. Construction fights usually center on payment, change orders, scope of work, and schedule delays between contractors, subcontractors, and property owners. Contractor license status can matter too, and the Construction Industry Licensing Board publishes license information. Lease disagreements often involve rent, repairs, and what the lease allows at storefronts, warehouses, and job sites. Owner disputes can arise under shareholder or partnership agreements. A written shareholder agreement signed by all shareholders can set out a process for resolving a deadlock. A single dispute may touch several of these areas, so review them together.

Talk With Ayala Law PA About Your Plant City Contract Dispute

Ayala Law PA focuses on business litigation, commercial litigation, contract disputes, shareholder disputes, construction litigation, real estate litigation, and international trade litigation in Florida courts and arbitration.
