A broken purchase agreement, a lease fight, or a boundary question can stall a deal for months. Ayala Law PA focuses on business litigation, including real estate litigation, for businesses and property owners in Riverview, Hillsborough County, and the Tampa Bay area. Those clients are served from the firm’s only office, at 1646 W Snow Ave in Tampa.

What Real Estate Disputes Look Like for Riverview Businesses

Most business real estate disputes start with a broken term in a written deal. Common examples include breach of purchase and sale agreements, commercial lease disagreements, title and boundary conflicts, and easement disputes. A buyer may say the seller missed a closing condition. A landlord and tenant may argue over rent, repairs, or when the lease ended. Neighbors and business partners may fight over a shared driveway or the edge of a parcel.

Owners and investors who develop or lease land often face questions about access, parking, and how a property can be used. Those questions are easier to answer early than after work has already started.

Many of these fights begin with a small gap on paper. A missing amendment, an unclear start date, or a closing condition nobody tracked can grow into a formal claim. Some matters may be referred to another lawyer or firm where appropriate. Ayala Law concentrates in real estate litigation within its business litigation practice.

If a stalled closing, a lease default notice, or a title problem has you weighing your next step, our team is ready to talk through what comes next. Each step has its own timing and paperwork. Missing a step can weaken a position, so keep track of every date.

Where a case is filed matters. Under Fla. Stat. § 47.011, Florida actions must be brought in the county where the defendant resides, where the cause of action accrued, or where the property in litigation is located. For a dispute over Riverview property, the county where the property sits is one place the statute allows.

Many money disputes also go to mediation, a meeting with a neutral mediator who helps both sides talk about settlement. Under Fla. Stat. § 44.102, a court must refer a filed civil action for money damages to mediation when one party asks, unless a listed exception applies. Mediation communications are generally confidential under Fla. Stat. § 44.405, with listed exceptions. Outcomes depend on the facts, the documents, and the law that applies. No general overview can predict how a specific dispute will end.

Deadlines and Documents That Shape Your Position

Florida generally gives five years to sue on a written contract and four years on an oral one. A claim generally starts its clock when its last element occurs, under Fla. Stat. § 95.031. A contract clause that sets a shorter time to sue is void, under Fla. Stat. § 95.03.

Notice and cure terms in your contract still matter, because they can control when you must act. Read them early, before you respond to any demand.

Real property transfers also have form rules. Under Fla. Stat. § 689.01, an interest in real property generally must be in writing and signed before two subscribing witnesses. Leases are exempt from the witness requirement. If a commercial tenant refuses to leave at the end of the lease, Fla. Stat. § 83.06 allows the landlord to demand double the monthly rent.

Gather the signed agreement, any amendments, closing statements, inspection reports, title commitments, rent ledgers, and all emails and texts. Keep them as they are. Avoid making statements about the dispute to the other side before you review your position.

Arbitration, Mediation, and Court: Choosing the Forum

The contract usually decides whether a real estate dispute goes to court or to an arbitrator. Under Fla. Stat. § 682.02, a written agreement to arbitrate is valid, enforceable, and irrevocable, except on a ground that allows a contract to be revoked. Federal law reaches similar contracts too. Federal law provides that a written arbitration provision in any maritime transaction or in a contract evidencing a transaction involving commerce, covering a controversy thereafter arising out of that contract or transaction or the refusal to perform all or part of it, as well as a written agreement to submit an existing controversy of that kind to arbitration, shall be valid, irrevocable, and enforceable, except on such grounds as exist at law or in equity for the revocation of any contract or as otherwise provided in chapter 4.

A court decides whether an arbitration agreement exists and whether a dispute falls under it. An arbitrator decides some threshold questions, such as whether a condition to arbitrating has been met. If one side refuses to arbitrate, a court can order arbitration under Fla. Stat. § 682.03. A court cannot refuse only because the claim seems weak. An order denying a motion to compel arbitration can be appealed, under Fla. Stat. § 682.20.

In general terms, arbitration is usually more private than a court case. It often limits discovery and appeal options. Court cases are public and follow court procedures. Neither path fits every dispute. The contract wording and your business goals should guide the choice.

Working With Ayala Law From Our Tampa Office

Ayala Law PA’s only office is at 1646 W Snow Ave in Tampa, and clients in Riverview are served from that office. The exact deadline depends on the facts and the contract.

Does a Florida real estate agreement have to be in writing?

Transfers of real property interests generally must be in writing under Fla.
