For business owners, landlords and investors, a dispute can stall a sale, interrupt rent or leave a building in limbo. This page explains the common disputes, the early steps that matter, and how these cases move through Hillsborough County. Ayala Law PA focuses on business and commercial litigation, and Eduardo A. Maura is the responsible lawyer.

What Real Estate Litigation Covers for Temple Terrace Businesses

Real estate litigation covers lawsuits and arbitration over the rights tied to commercial property. It includes leases, purchase contracts, and the relationships between owners and investors. Business owners, landlords and investors may need it when a deal or property relationship breaks down. A tenant stops paying, a buyer walks away from a contract, or two partners disagree about a building they share.

Every dispute turns on specific paperwork, so the first step is knowing what your documents say. Florida’s commercial tenancy rules apply to nonresidential tenancies under Fla. Stat. § 83.001. Many business properties in Temple Terrace sit in Hillsborough County. County property records and local venue rules often shape where a dispute is heard.

If a stalled closing or an unpaid lease has your Temple Terrace property at risk, our team is ready to talk through your options and what comes next. Each one usually starts with a specific event. A tenant misses a rent payment and the landlord sends a notice. A closing date passes because a document never arrived. A survey shows a fence sitting over the property line. One owner blocks a shared driveway. Co-owners argue over repairs, rent or whether to sell.

Early action matters because a stalled dispute can cost rent, deposits and time. Waiting often narrows your options.

Construction-related matters are different. Lien foreclosure and contractor disputes fall under our construction litigation practice and are covered separately, not on this page.

Commercial Lease Defaults and Tenant Eviction in Florida

A lease default is a failure to meet the terms of a lease. An eviction is the court process for getting a tenant out of the space. A default does not always lead to eviction, so read the lease before choosing a path. When a tenant refuses to give up possession at the end of the lease, Florida law lets the landlord demand double the monthly rent. Fla. Stat. § 83.06 also says rent contracts bear interest from the time the rent becomes due.

The lease language decides a lot. Read the notice requirements, cure periods and rent terms closely before acting. A cure period is the time a tenant has to fix a default. Missing a notice step can weaken either side’s position. Timing depends on the lease, the facts and the court’s calendar, so no fixed schedule fits every case.

Purchase Contracts, Deposits, and Closing Disputes

Most closing disputes turn on what the signed contract says about deposits, inspections, financing and the closing date. Earnest money is the deposit a buyer posts to show commitment. The fight is often over who keeps it when a deal collapses. A due diligence period gives a buyer time to inspect the property and review records. A financing contingency can let a buyer back out if a loan falls through, when the contract allows it. Closing conditions list what must happen before title transfers.

Start with three questions. What does the contract require, and by when? What notices were sent, and how? What documents show what the parties agreed? Florida also voids any contract term that sets a shorter time to sue than the statute allows, under Fla. Stat. § 95.03. Remedies depend on the contract and the facts, so we review the documents before recommending a path.

How a Real Estate Dispute Moves Through Hillsborough County Courts and Arbitration

Most disputes move in stages. They start with document review and a written demand. Next come negotiation or mediation, and then a filing in court or arbitration. Discovery, the exchange of documents and testimony, follows a filing.

Venue is a key question. Under Fla. Stat. § 47.011, actions are brought in the county where the defendant resides, where the cause of action accrued, or where the property in litigation is located. For a Temple Terrace property, Hillsborough County may be a proper place to file, depending on the facts.

Under Fla. Stat. § 44.102, a court must refer most civil actions for money damages to mediation when one party asks. Exceptions apply, including landlord and tenant disputes that do not include a personal injury claim. If your contract has a written arbitration clause, Fla. Stat. § 682.02 says that clause is generally enforceable. If a party refuses to arbitrate, Fla. Stat. § 682.03 lets the court order arbitration when an enforceable agreement exists.

Before a first conversation, gather the lease or contract, letters and emails, payment records, and any notices sent or received.

Working With a Tampa Firm on Temple Terrace Real Estate Matters

Ayala Law PA serves Temple Terrace and Hillsborough County clients from its only office, at 1646 W Snow Ave in Tampa.
