If you have appealed a court decision or are considering whether to appeal, you may have one question that keeps coming up, “What actually happens during an appellate court hearing?”

An appeal can feel unfamiliar, especially if you have already been through a trial or hearing in the lower court. You may expect to tell your story again, present witnesses, or introduce new evidence. Usually, that is not what an appellate hearing is about.

An appellate court generally reviews whether the lower court made a legal error based on the record that already exists. Understanding how the process works can help you know what to expect and, just as importantly, what an appeal can and cannot accomplish.

What Is an Appeal in Florida?

An appeal is a request for a higher court to review a decision made by a lower court. In Florida, appeals may involve decisions from circuit courts, county courts, administrative proceedings, and other matters depending on the circumstances.

The purpose of an appeal is generally not to retry the entire case. Instead, the appellate court examines the lower court’s proceedings and determines whether a legal error occurred that affected the outcome.

That distinction is important. Winning at trial does not necessarily mean the other side has no further options, and losing does not automatically mean an appeal will succeed.

What Happens Before an Appellate Court Hearing?

Much of an appeal happens before anyone appears in front of the appellate judges.

The appellate record, briefs, and applicable law are central to the process. The attorneys explain why the lower court’s decision should be affirmed, reversed, or otherwise modified.

Unlike a trial, the appellate process generally does not revolve around calling witnesses and presenting new evidence. Instead, the focus is on the legal issues raised by the appeal.

What Does an Appellate Brief Do?

An appellate brief is one of the most important parts of an appeal. It gives the court the legal arguments supporting a party’s position and explains how the law applies to the issues presented.

A strong appellate brief does more than argue that the lower court was “wrong.” It identifies the specific alleged error, explains the applicable law, and connects that law to what happened in the underlying case.

What Happens During an Appellate Court Hearing?

If the appellate court schedules oral argument, the attorneys appear before a panel of appellate judges. The attorneys typically make legal arguments and answer questions from the judges. The judges may interrupt an attorney to ask about a statute, prior case, procedural issue, or particular fact in the record.

This can make appellate oral argument feel very different from a trial. There may be no witnesses. There may be no jury. The attorneys are not simply telling the client’s story from beginning to end. Instead, they are addressing the legal questions that the appellate court must decide.

Do You Have to Speak During an Appeal?

Usually, the attorneys, not the parties, present the arguments during appellate oral argument. If you are the person who filed the appeal or the person defending the lower court’s decision, you generally will not be asked to take the witness stand and explain what happened.

Your appellate attorney’s job is to present the legal arguments and respond to the court’s questions.

Can You Introduce New Evidence on Appeal?

Generally, an appeal is decided based on the existing record from the lower court. That means you typically cannot use an appeal as an opportunity to introduce evidence that was never presented at trial. This is one reason it is so important to preserve the right evidence and make appropriate arguments in the trial court.

An appellate lawyer therefore needs to understand not only appellate law, but also what happened in the underlying proceeding and what the existing record actually contains.

How Long Does an Appellate Court Hearing Last?

There is no single answer. The amount of time allocated for oral argument depends on the court and the particular case.

In many appeals, the actual oral argument may be relatively short compared with the amount of work that goes into preparing the briefs, reviewing the record, researching the law, and preparing for questions from the judges. The hearing itself is only one part of the appellate process.

What Happens After Oral Argument?

The appellate court does not necessarily announce its decision immediately after the hearing. 

The judges may take the case under advisement and issue a written decision later. Depending on the outcome, the court may affirm the lower court’s decision, reverse it, remand the case for further proceedings, or take another action permitted by law. In some cases, further appellate procedures may also be available.

Why Is Appellate Litigation Different From Trial Litigation?

Trial litigation and appellate litigation require overlapping but different skills.

At trial, an attorney may focus heavily on evidence, witnesses, cross-examination, motions, and presenting a compelling case to a judge or jury. On appeal, the focus shifts toward identifying legal error, interpreting statutes and precedent, analyzing the record, and presenting precise legal arguments.

For a business, some legal disputes cannot wait for a trial.

A former employee may be preparing to take confidential information to a competitor. A business partner may be transferring company assets. A competitor may be using confidential trade information. A party to a contract may be taking an action that could cause damage that money alone cannot adequately repair.

In situations like these, a business may need to ask a court to intervene before the underlying lawsuit is resolved. One of the primary tools available in these circumstances is an injunction.

An emergency injunction can be a powerful remedy, but it is not automatically available simply because a business is facing serious harm. Florida courts apply specific legal standards when deciding whether to grant this extraordinary relief.

What Is an Emergency Injunction in Florida?

An injunction is a court order requiring a person or business to do something or refrain from doing something. An emergency injunction for a business is generally sought when waiting for the normal litigation process could allow the harm to occur before the court has an opportunity to resolve the underlying dispute.

For example, imagine a company discovers that a former executive is about to disclose confidential business information to a competitor. A lawsuit for damages might eventually compensate the company for some losses, but by the time the case reaches trial, the information may already be public. The business may instead seek immediate injunctive relief to prevent the disclosure while the larger dispute proceeds.

When Can a Business Get an Emergency Injunction?

Florida courts generally consider four factors when determining whether temporary injunctive relief is appropriate:

1. A substantial likelihood of success on the merits
2. A substantial likelihood of irreparable harm without the injunction
3. Whether the threatened injury to the business outweighs the potential harm the injunction could cause the opposing party
4. Whether granting the injunction would be consistent with the public interest

These requirements matter because an injunction can significantly affect another party’s rights before the case has been fully decided.

A business therefore needs more than an allegation that the other side is acting unfairly. The request should be supported by facts, evidence, and a clear explanation of why immediate court intervention is necessary.

What Counts as Irreparable Harm to a Business?

One of the most important issues in an emergency injunction case is irreparable harm. Not every financial loss qualifies. If a business can simply calculate its damages and recover that amount through a conventional lawsuit, a court may conclude that an injunction is unnecessary.

The situation becomes different when the damage cannot easily be repaired with money. Examples can include:

• Disclosure of confidential or proprietary information
• Misappropriation of trade secrets
• Destruction or alteration of important evidence
• Improper transfer of business assets
• Interference with certain contractual or business relationships
• Conduct that could cause damage that is difficult to quantify

The specific facts of the dispute matter. A court will look at the actual threatened injury rather than simply accepting a general statement that the business will suffer financially.

Can a Business Get an Injunction Against a Former Employee?

Yes, in appropriate circumstances. Employment-related disputes are a common context for requests for injunctive relief. For example, a business may have evidence that a former employee is taking confidential customer information, trade secrets, proprietary documents, or other protected information.

But an employer cannot assume that every dispute with a former employee justifies an injunction. The business needs to identify the legal right being protected and demonstrate why immediate intervention is necessary. Depending on the circumstances, the dispute may also involve noncompete agreements, confidentiality agreements, trade secret protections, or other contractual obligations.

Can an Injunction Stop a Business Partner From Taking Company Assets?

Potentially. Partnership and shareholder disputes can become particularly urgent when one party is allegedly transferring, concealing, or misusing company property.

Waiting until the end of litigation may not be practical if company assets are being dissipated while the case is pending. In those circumstances, an injunction may be considered as part of a broader business litigation strategy designed to preserve the status quo while the underlying ownership or contractual dispute is resolved.

What Is the Difference Between a Temporary Injunction and a Permanent Injunction?

A temporary injunction is generally intended to provide immediate or short-term relief while litigation continues. It does not necessarily mean that the party requesting the injunction has already won the lawsuit.

A permanent injunction, by contrast, is typically considered as part of the court’s final resolution of the underlying dispute. This distinction is important. A business seeking emergency relief needs to establish why the court should intervene now, before the case has reached its final resolution.

What Evidence Do You Need for an Emergency Injunction?

The strength of an injunction request often depends on the evidence supporting it. Depending on the dispute, evidence may include:

• Contracts and agreements
• Emails and other communications
• Business records
• Financial documents
• Affidavits or declarations
• Evidence of threatened disclosure or transfer of property
• Confidentiality or restrictive covenant agreements
• Corporate records
• Evidence showing the immediacy and seriousness of the threatened harm

A vague allegation that something bad might happen is unlikely to be enough. The court needs a factual basis for determining whether emergency relief is justified.

How Quickly Can a Florida Court Issue an Injunction?

The answer depends on the circumstances and the type of relief requested.

Emergency injunction proceedings can move much more quickly than ordinary litigation. In particularly urgent circumstances, a party may ask the court for immediate relief rather than waiting months for a case to proceed through discovery and trial. That speed also makes preparation especially important.

If your business is facing an imminent threat, waiting until the damage has already occurred can make an injunction significantly less useful. The timing of the legal response can therefore be just as important as the underlying legal claim.

Do You Need a Lawyer to Seek an Emergency Injunction?

Because an injunction can immediately affect the rights and conduct of the opposing party, these cases require careful preparation.

A business should consider not only whether it has a legal claim, but also whether emergency injunctive relief is the appropriate remedy, what evidence supports the request, and how the requested order should be structured.

A significant commercial dispute involving more than $1 million in unpaid invoices for shipments of limes from Peru is moving forward after we successfully defeated a motion to dismiss filed by the opposing party.

We are proud to announce that we have obtained a jury verdict that largely vindicates our client’s rights. The case involved our client’s sale of sophisticated stone-and marble-cutting equipment to the plaintiff. 

The plaintiff claimed that the machine did not work or perform as she expected. 

At trial, our attorneys introduced evidence that our client never promised the machine’s automatic laser-cutting function, which was sold via third parties and was never part of the initial contract or the negotiations leading up to the agreement. 

The plaintiff tried to blame our client for simply handing over a third-party contractor’s business card, a business card that sold the laser software that allegedly wasn’t integrating with the saw’s built-in software. 

Attorneys Eduardo A. Maura and Orestes Garcia tried the case. As stated by attorney Orestes Garcia, “We are extremely happy about the result. The plaintiff requested nearly $1.3 million in damages without any evidentiary basis whatsoever. In the end, we fully defeated the contract claim, and the $43,000 awarded on the negligent misrepresentation claim is less than 20% of what we were voluntarily willing to pay the plaintiff.”

Winning your case is a huge milestone, but obtaining a final judgment is not always the end of the legal battle. In many Florida lawsuits, the losing party will file a Motion to Stay Execution of a Final Judgment in an attempt to delay collection efforts. If you’ve successfully obtained a judgment, you may be wondering: Can the court deny a motion to stay execution of a final judgment?

The short answer is yes. Under Florida law, courts frequently deny these motions when the party requesting the stay fails to meet the legal requirements. Understanding when a stay should be denied can help judgment creditors protect their rights and recover what they are owed sooner.

What Is a Motion to Stay Execution of a Final Judgment?

A motion to stay execution of a final judgment asks the court to temporarily prevent the winning party from enforcing a judgment while post-trial motions or an appeal are pending.

Without a stay, the prevailing party may pursue lawful collection methods, including recording judgment liens, garnishing accounts, or, in some cases, enforcing equitable liens or foreclosure proceedings. However, a stay is not automatic simply because the losing party disagrees with the outcome.

When Will a Florida Court Deny a Motion to Stay Execution?

Florida courts generally require the party seeking a stay to demonstrate good cause. If they cannot meet that burden, the court should deny the request.

The Party Cannot Show Good Cause for a Stay

One of the most common reasons courts deny a motion to stay is because the moving party fails to establish good cause.

Simply arguing that the judgment is unfair or that post-trial motions are pending is usually not enough. Florida courts expect specific legal and factual reasons explaining why delaying enforcement is justified. If the motion merely repeats arguments already rejected by the court or jury, the judge is unlikely to grant a stay.

Does Losing Property Count as Irreparable Harm?

Many people assume that losing property automatically qualifies as irreparable harm. Under Florida law, that is generally not the case.

Courts distinguish between harm that can be compensated with money and harm that truly cannot be repaired. Economic losses—even significant ones—are usually considered compensable through monetary damages. For that reason, the possibility of foreclosure or the enforcement of an equitable lien does not automatically justify staying enforcement of a final judgment.

Can Financial Hardship Justify a Stay?

Financial hardship alone rarely guarantees a stay. In fact, Florida courts have recognized an important point: if a judgment debtor truly has no reachable assets or income, they may not suffer meaningful prejudice from the judgment remaining in place while litigation continues.

On the other hand, if the debtor does possess assets, courts are often concerned about protecting the judgment creditor’s ability to collect before those assets disappear.

Will the Court Consider Harm to the Winning Party?

Absolutely. Florida courts balance the interests of both parties—not just the party requesting the stay.

If delaying enforcement would create a substantial risk that the prevailing party may never collect on the judgment, that weighs heavily against granting a stay. Courts are particularly cautious when there is evidence that assets could be transferred, hidden, dissipated, or otherwise placed beyond the reach of creditors. Justice delayed can easily become justice denied if collection opportunities disappear.

Does the Public Interest Matter?

Yes. Florida courts recognize that judicial orders must have meaning. If final judgments could routinely be delayed without sufficient legal justification, public confidence in the judicial system would suffer.

Courts therefore consider whether granting a stay would undermine the enforcement of valid judgments or unnecessarily delay justice.

Is a Bond Required to Stay a Final Judgment?

In many cases, yes. A party requesting a stay is often required to post a supersedeas bond to protect the judgment creditor while the case continues.

The purpose of the bond is straightforward: if the appeal or post-trial motions fail, the prevailing party should still be able to collect the judgment. If the party requesting the stay cannot justify eliminating or reducing the bond requirement, the court may require a full bond or deny the stay altogether.

What Should You Do If the Other Side Files a Motion to Stay?

If you’ve won your case and the opposing party files a motion to stay execution of the final judgment, it’s important to respond quickly. An experienced Florida litigation attorney can evaluate whether:

• The moving party has established good cause.
• They have demonstrated legally recognized irreparable harm.
• A stay would unfairly prejudice your ability to collect.
• A supersedeas bond should be required to protect your interests.

At Ayala Law, we believe one of the most important rights a client has is the right to decide whether to settle a lawsuit. That principle was recently reinforced when attorney Julia Solivan successfully opposed a Motion to Enforce Settlement in a commercial litigation matter.

The dispute arose just two days before trial, when settlement negotiations intensified between counsel. The opposing party argued that a binding settlement had been reached because our client’s former attorney accepted a settlement proposal. Our client, however, maintained that he never gave his attorney absolute and unequivocal authority to accept those terms.

Florida law is clear on this issue. An attorney’s representation of a client does not, by itself, create implied or apparent authority to settle a case. The party seeking to enforce a settlement must prove that the attorney had the client’s clear, absolute, and unequivocal authorization to do so.

On behalf of our client, Julia Solivan argued that the alleged settlement could not be enforced without first resolving the factual dispute over whether that authority actually existed. The court agreed that the issue could not be decided solely from the written filings and set the matter for an evidentiary hearing, where testimony and evidence will determine whether the client authorized the settlement.

While the ultimate question of settlement authority will be decided at the evidentiary hearing, this ruling is an important procedural victory because it ensures our client has the opportunity to present evidence before being bound by an agreement he contends he never approved.

Attorney Julia had this to say, “This ruling is a crucial step because it ensures our client has the opportunity to be heard before being bound by a settlement he maintains he never approved. That’s exactly what due process is intended to protect.” 

This case also serves as an important reminder for anyone involved in litigation. Although attorneys negotiate on behalf of their clients every day, the decision to settle always belongs to the client. If there is a genuine dispute over whether a client authorized a settlement, Florida courts require that issue to be resolved before enforcing the agreement.

The ruling is an important reminder that Florida courts do not simply set aside default judgments because a defendant decides to participate after the fact. A party asking a court to vacate a default must satisfy a strict legal standard, and in this case, the court determined that standard was not met.

What Is a Default Judgment?

A default judgment may be entered when a defendant fails to respond to a lawsuit within the time required by law. While some people assume a default automatically ends a case, Florida law allows a defendant to ask the court to set it aside under certain circumstances. However, that relief is not automatic.

To vacate a default judgment, a defendant generally must demonstrate:

• A valid legal reason (known as excusable neglect) for failing to respond.
• A potentially meritorious defense to the claims.
• That they acted promptly after learning about the default.

Failing to establish any one of these elements can result in the motion being denied.

Why the Court Refused to Vacate the Judgment

After reviewing the evidence and legal arguments, the court denied the defendant’s request to undo the default judgment. We argued that the defendant had not met the legal requirements necessary to justify reopening the case, and the court ultimately agreed, allowing the judgment to remain in place.

This outcome reinforces an important principle of Florida civil litigation: court deadlines matter. Parties cannot simply ignore legal proceedings and later expect to restart the case without meeting the requirements established under Florida law.

A Strong Result for Our Client

For our client, this ruling means the judgment they previously obtained remains intact, avoiding unnecessary delay and additional litigation.

Attempts to vacate default judgments can significantly increase the cost and length of a lawsuit. Successfully opposing these motions helps preserve judicial efficiency while protecting clients who have already followed the legal process and secured favorable results.

Businesses rely on contracts to keep operations running smoothly. So, when one company provides valuable services but is not paid, the financial impact can be significant. Recovering those unpaid funds often requires more than repeated requests for payment, but decisive legal action.

We recently reached a successful settlement on behalf of a Florida vehicle-washing and detailing company in a commercial collections dispute involving allegedly unpaid invoices. The settlement allows our client to recover funds they were owed and brings the dispute to a resolution after months of unsuccessful attempts to collect payment.

The Dispute

According to the allegations in the complaint, our client entered into a service agreement with a vehicle rental company in 2022 to provide vehicle washing and detailing services. Under the agreement, our client regularly cleaned and detailed the defendant’s fleet and submitted invoices for the work performed.

For a period of time, the business relationship operated as expected. However, the complaint alleges that beginning in April 2024, the defendant stopped paying invoices despite continuing to receive services.

As the unpaid balance continued to grow, our client repeatedly attempted to resolve the issue directly. According to the complaint, those efforts included multiple communications requesting payment and providing opportunities for the outstanding balance to be addressed. Despite those efforts, the invoices remained unpaid. When informal collection efforts failed, our client retained us to protect their interests.

Enforcing Contractual Rights

We filed a lawsuit asserting claims for breach of contract and, alternatively, unjust enrichment. The complaint alleged that the defendant received the benefit of our client’s services while failing to pay for them as required under the parties’ agreement. Following the filing of the lawsuit, the parties were able to negotiate a settlement that resolves the dispute and provides our client with a path to recover funds that were owed.

This matter demonstrates that businesses do not have to accept substantial unpaid invoices as a cost of doing business. When contractual obligations are not honored, Florida law provides legal remedies that may allow businesses to pursue the compensation they have earned.
