We are proud to announce that we have defeated our plaintiff’s attempt to add a claim for punitive damages against our client in a case where our client sold glass panels to the plaintiff.

The case involved the construction of a $30-million property by the plaintiff, who hired a general contractor to install the windows. The contractor, in turn, hired our client, a large manufacturer of glass panels, windows, and glass doors.

As alleged by our client, the contractor failed to properly measure the frames where the windows were to be placed, resulting in some of the ordered windows not fitting. Our client subsequently refunded the $100,000 deposit they received for the order. The plaintiff sued the contractor and our client, the manufacturer, alleging breach of contract and product defects.

The plaintiff, knowing the contractor lacked financial resources, decided to aggressively pursue the case against the manufacturer. In the process, the plaintiff alleged that the sold windows lacked the required Florida approvals and that this was hidden from him. Based on this theory, the plaintiff asked the court to include a claim for punitive damages in what was basically a contract case.

Our lawyers showed the court plenty of evidence that the plaintiff knew some of the frames lacked approval, because they were custom-made for this project, and approvals are obtained during the project.

The court summarily denied the request to add a claim for punitive damages, stating that even if the plaintiff could prove any breach by our client, this was not an “egregious case that demands damages beyond the regular contract damages.”

As stated by attorney Eduardo A. Maura, “We are happy that the court denied this baseless motion. This is nothing but litigation tactics, an effort to go after the deeper pocket party on a case that has been overly litigated and now is upside down in value.”

So, what should the plaintiff (the party who filed the lawsuit) do next?

That’s where the question comes in, “Do I need to file a reply to that defense?”

Do You Need to File a Reply in Florida When the Statute of Limitations Is Raised?

Short Answer: Only if you are going to avoid or challenge the defense using new facts.

Long Answer: Under Florida Rule of Civil Procedure 1.100(a), a reply to an affirmative defense is not automatically required unless the plaintiff wants to avoid the defense with facts not already included in the complaint.

Here’s an example:

• Let’s say the defendant raises a statute of limitations defense.
• But you believe the time limit should be paused (or “tolled”) because the defendant concealed facts, or because of fraudulent misrepresentation.

That argument might require new factual allegations that weren’t in the original complaint. In that case, you’d need to file a reply to the affirmative defense.

When Is a Reply to the Statute of Limitations Defense Required?

If you plan to raise any of the following arguments to challenge the statute of limitations, you’ll likely need to file a reply:

• Equitable Tolling: You’re arguing that the time limit should be extended due to fairness, like fraud or extraordinary circumstances.
• Continuing Violation Doctrine: You’re claiming the wrongful conduct continued over time, keeping the clock running.
• Delayed Discovery: You didn’t discover the harm or wrongdoing until later, and that discovery triggers the time period to file suit.
• Waiver or Estoppel: The defendant took actions that caused you to delay filing, and now they shouldn’t be able to use that delay against you.

These legal theories often require new facts or legal arguments, and courts will expect you to raise them in a formal reply.

What Happens If You Don’t Reply to the Statute of Limitations Defense?

We are pleased to announce that we successfully represented our appellant before Florida’s Second District Court of Appeal, securing a reversal of the trial court’s award of attorneys’ fees to the appellee, a homeowners association.

The appeal arose after the lower court granted attorneys’ fees to the association following a summary judgment ruling against our client in a towing-related dispute. Our team argued that there was no legal basis for the fee award because the underlying claim was not one for enforcement of a contractual right under the community’s governing documents, but rather a statutory claim regarding improper towing.

The appellate court agreed, concluding that the association was not entitled to attorneys’ fees under its recorded declaration. The court found that the litigation did not constitute enforcement of the declaration’s restrictions and that the fee provision did not apply to the nature of the underlying dispute, which was governed by Florida Statute § 715.07—not the association’s governing documents.

This decision reinforces the principle that attorneys’ fee provisions in recorded declarations must be strictly construed and only apply when litigation arises directly from or enforces the contractual terms they govern.

We commend the efforts of our litigation team on this result. The ruling not only protects our client from an unwarranted financial burden but also helps clarify the scope of attorneys’ fee entitlement in community association disputes across Florida.
