Ayala Obtains Full Defense Judgment in Million-Dollar Multi-Family Real Estate Dispute Trial

Ayala is proud to announce that it has obtained a full defense judgment in a real estate dispute over the payment of a $500,000 loan collateralized by a Miami multifamily building now worth over $1 million.

The complaint alleged that Ayala’s client, the defendant, unlawfully transferred the propertyโ€™s title (jointly owned by the parties) to a company co-owned by both.

The complaint in the case included claims of Civil Theft, Conspiracy, Quiet Title, and Slander of Title, among others.

Ayalaโ€™s client stated in his defense that the plaintiff had previously signed documents transferring the property to a trust (including a power of attorney), where she clearly authorized the defendant to carry out such transfers.

At trial, Ayalaโ€™s client testified that the transfer was not done for fraudulent purposes, as claimed in the complaint, but rather to protect the creditor who had lent the money to purchase the asset in question, and who was also a longtime friend of both the plaintiff and the defendant.

In the end, the court sided with Ayalaโ€™s client, ruling, among other findings, that:

โ€œPlaintiff ha[d] failed to meet its burden of proof on all the Counts pleaded and tried before the Court. The documents executed are declared valid and support authority for the transfers that occurred.โ€

Attorney Eduardo A. Maura and Orestes Garcia tried the case.ย As Eduardo A. Maura stated, “We are very pleased with the outcome. The court recognized that our client acted legally, that the transfer was legitimate based on validly executed documents, and that it was done to protect a debt. Our client never made a penny out of this.โ€
