Appeals

A trial and a verdict are not always the end of the road in litigation. Sometimes, the unhappy party will want to appeal the result to a higher court. Our firm is well-equipped to handle appeals in state and federal courts of appeals.

With oral argument being the exception rather than the norm, writing skills are essential when appealing or defending appeals. At Ayala we take pride in having attorneys with top writing skills. We have handled appeals in several Florida District Courts and in the United States Eleventh Circuit Court of Appeals.

Peaceful Paws Memorial Services LLC, v. Karen Tarves, 3d23-348, 2023 WL 4916055 (3rd DCA Aug. 2, 2023) (reversing court order order of default against our client)

Forte v. All Cty. Towing Inc., No. 4D21-1379, 2022 Fla. App. LEXIS 2049 (4th DCA Mar. 23, 2022) (finding that the trial court erred in failing to hold an evidentiary hearing regarding the amount of attorneys’ fees).

SC Mota Associates Ltd. P’ship v. Mota Pizza Rustica Corp., 358 So. 3d 823, 826 (Fla. 3d DCA 2023) (concluding that the trial court did not abuse its discretion in ratifying the denial of a sanctions motion against our client).
