Ayala is proud to announce that we have obtained an order quashing service of process against our client in an action involving claims for defamation.
The case came to the firm already in default. Shortly after being retained, attorney Julia Solivan identified several errors in the plaintiff’s affidavit of service that violated Section 48.161(2) of the Florida Statutes regulating service of process in civil cases.
The errors included service to the wrong address, failure to specify date and time, and method of service, among others.
As stated by attorney Solivan, “We are glad the judge agreed with us and we were able to vacate the default. Not only are the underlying defamation claims unfounded, but our client is entitled to be properly notified of this action so he can fully defend himself.”
