In a significant win for our client, Ayala has obtained a nearly $34,000 attorney fee and cost award following a successful trial.
Challenging the Unlawful Towing Incident
The case revolved around a condo association in Orlando, which illegally ordered the tow of our client’s vehicle while he was away on vacation. Instead of taking responsibility and compensating for the damages, the condo association opted for a contentious jury trial.
At trial, our client’s rights were vindicated as the jury sided in their favor. Florida Statute Section 715.07 granted our client the right to attorney fees due to prevailing in court.
Prolonged Dispute & Resilient Defense
Despite the verdict, the condo association refused to pay the awarded amount and continued to dispute the fee, aiming to minimize our client’s entitlement to a mere 1/6 of the total amount.
On July 18, 2023, Judge Vincent Falcone III of the Ninth Judicial Circuit in Orange County, Florida, rendered a judgment for almost the entire fee request, granting nearly $34,000 in favor of our client.
Upholding Justice and Client’s Rights
Attorney Eduardo A. Maura expressed immense satisfaction with the Judge’s order, “We’re happy with the Judgeโs order. It gives us 95% plus of what we requested. We’re happy the Judge didn’t buy into the defenseโs awkward theory, arguing that in a simple case where the single fact was the tow of a vehicle, our client should be entitled to 1/6th of the case’s total amount of fees.โ
