Ayala Law Files Lawsuit Over Alleged Six-Figure Publishing Fraud Scheme

We recently filed a lawsuit on behalf of a client who alleges he was the victim of an elaborate publishing and distribution scheme that cost him more than $175,000 in lost funds and unpaid royalties.

According to the complaint, our client retained multiple companies that marketed themselves as professional publishing, marketing, printing, and book distribution firms. The lawsuit alleges that these companies made extensive promises regarding nationwide and international distribution, guaranteed royalty payments, marketing campaigns, and other publishing services designed to help launch and monetize the author’s literary works.

Our client fulfilled his obligations, paying tens of thousands of dollars for publishing, printing, marketing, and distribution services while relying on contractual guarantees that substantial royalty payments would follow. The lawsuit alleges that despite these promises, the services were never performed, guaranteed royalty payments were never made, and the companies abandoned their contractual obligations while retaining the funds they received.

The complaint further alleges that the defendants operated through multiple interconnected entities that shared personnel, contact information, and management, creating the appearance of separate businesses while functioning as a single enterprise. Based on these allegations, our firm has asserted claims for

  • Breach of Contract
  • Fraud in the Inducement
  • Fraudulent Misrepresentation
  • Violations of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA)
  • Civil theft

This lawsuit, spearheaded by partner Ryan Sawal and attorney Eion Oosterbaan, is a reminder that business owners, authors, and entrepreneurs are prime targets for fraudulent digital schemes disguised as a legitimate business relationship supported by contracts, invoices, polished marketing materials, and ongoing communications.
