Ayala Secures Critical Victory, Reopening Fight Over Disputed Settlement Agreement in High-Stakes Business Dispute

By June 19, 2026No Comments

We are proud to announce a significant courtroom victory achieved by attorney M. Julia Solivan, Esq. in a complex commercial litigation matter involving a dispute between two members of an LLC.

The case centered on an alleged settlement agreement that our client consistently maintained she never approved, authorized, or agreed to. The agreement exposes her to financial consequences reaching into the hundreds of thousands, and potentially millions, of dollars in assets in Miami and South America.

After taking over the matter, we successfully challenged the circumstances surrounding the purported settlement agreement and obtained relief staying enforcement of the agreement while the Court entertains a motion for rehearing.

How the Dispute Reached This Point

Before coming to Ayala Law, our client found herself in an increasingly difficult position. According to the allegations presented to the court, settlement discussions began while she was represented by prior counsel in a business dispute involving jointly owned company interests. As negotiations progressed, proposed terms changed and evolved. Our client repeatedly objected to those changes and communicated that she did not agree with the proposed resolution.

Despite those objections, opposing counsel was informed that a settlement had been reached. The dispute ultimately led to litigation over whether a binding agreement existed.

Compounding the problem, our client was left without legal representation during a critical evidentiary hearing regarding enforcement of the alleged settlement. The court ruled against her, placing her in a precarious position being bound by the terms of an agreement she did not authorize or accept.

Ayala Law Takes Over the Case

When our client retained Ayala Law, attorney Julia Solivan immediately began evaluating the record, the procedural history, and the events surrounding the alleged agreement.

The firm pursued a strategy aimed at ensuring the court had the opportunity to fully consider whether the purported settlement was authorized and accurately reflected our client’s intentions.

That effort resulted in a significant victory that effectively stayed the immediate enforcement of an agreement our client maintains she never approved.  The Court further agreed to conduct a rehearing to determine whether a legally enforceable agreement was formed between the parties.

“This case was about ensuring that our client’s voice was not lost in the process,” said Julia Solivan, Esq. “Because a party may be bound by a settlement agreement that was never authorized, the Court must carefully scrutinize the facts and circumstances surrounding the alleged agreement. We are proud to advocate for our client and to secure an outcome that allows her to continue defending her interests.”

Our Commitment to Business Litigation
