The case centered on an alleged settlement agreement that our client consistently maintained she never approved, authorized, or agreed to. Had the agreement remained in place, it could have exposed her to financial consequences reaching into the hundreds of thousands, and potentially millions, of dollars.
After taking over the matter, we successfully challenged the circumstances surrounding the purported settlement and obtained relief that allows our client to continue defending her rights on the merits.
How the Dispute Reached This Point
Before coming to Ayala Law, our client found herself in an increasingly difficult position. According to the allegations presented to the court, settlement discussions began while she was represented by prior counsel in a business dispute involving jointly owned company interests. As negotiations progressed, proposed terms changed and evolved. Our client repeatedly objected to those changes and communicated that she did not agree with the proposed resolution.
Despite those objections, opposing counsel was informed that a settlement had been reached. The dispute ultimately led to litigation over whether a binding agreement existed.
Compounding the problem, our client was left without legal representation during a critical evidentiary hearing regarding enforcement of the alleged settlement. The court initially ruled against her, placing her in a precarious position and leaving her facing the possibility of being bound by terms she contended she never accepted.
