Ayala Files Class Action Lawsuit Against YouFit Health Clubs for Charging Membership Fees After Consumer Cancellations

Ayala Law filed a class action in Miami-Dade County against YouFit Health Clubs for charging consumers membership fees despite their explicit cancellation requests.

In the lawsuit, Fernandez, the class representative, alleges that she held a membership with the Defendant for access to its gym facilities and other services.

On May 15th, 2018, Fernandez went to her local YouFit gym in person at 7070 Coral Way, Miami, FL, 33155, to cancel her membership with the Defendant. That same day, she was assisted by an agent of the Defendant, and executed the Defendant’s membership cancellation form at the Coral Way YouFit gym location. This 2018 membership cancellation form was also executed by the Defendant’s agent, and expressly provided that Fernandez would not be responsible for the next invoice related to her membership, and that Fernandez did not have a recurring service with YouFit.

The class action complaint alleges that Fernandez paid all the required fees, including a $10.00 cancellation fee, and all the processing fees associated with her 2018 membership cancellation form. However, despite these cancellations, the Defendant continued to charge Fernandez’s Chase bank account. From June 2017 through June 2024, the Defendant has charged Fernandez’s bank account approximately $374.37 per year, totaling $2,650.00. It was in or around June 2024 when Fernandez realized that YouFit had been charging her bank account.

As a result of the Defendant’s tortious, wrongful and unfair practices, Fernandez and others similarly situated have incurred damages by being charged thousands of dollars for memberships which they properly cancelled and received no benefit from thereafter.
