Ayala Obtains Jury Verdict Defeating $1.3 Million Claim in Dispute Involving the Sale of Industrial Equipment

We are proud to announce that we have obtained a jury verdict that largely vindicates our client’s rights. The case involved our client’s sale of sophisticated stone-and marble-cutting equipment to the plaintiff. 

The plaintiff claimed that the machine did not work or perform as she expected. 

At trial, our attorneys introduced evidence that our client never promised the machine’s automatic laser-cutting function, which was sold via third parties and was never part of the initial contract or the negotiations leading up to the agreement. 

The plaintiff tried to blame our client for simply handing over a third-party contractor’s business card, a business card that sold the laser software that allegedly wasn’t integrating with the saw’s built-in software. 

Attorneys Eduardo A. Maura and Orestes Garcia tried the case. As stated by attorney Orestes Garcia, “We are extremely happy about the result. The plaintiff requested nearly $1.3 million in damages without any evidentiary basis whatsoever. In the end, we fully defeated the contract claim, and the $43,000 awarded on the negligent misrepresentation claim is less than 20% of what we were voluntarily willing to pay the plaintiff.”
