Ayala Reduces Half-a-Million Claim Against its Client to a $10,000 Settlement

Ayala is happy to announce that it has settled a case where the plaintiff was claiming half a million in damages against its client.

The allegations insinuated that Ayala’s client, a coach bus operator, had “stolen” two of the plaintiff’s Irizar coach buses worth approximately $250,000 each.

The plaintiffs and the defendant had a contractual relationship for the buses operations where the plaintiff had to pay Ayala’s client certain amounts for the operation of the buses, which the plaintiff failed to do.

When the plaintiff demanded the return of the buses, Ayala’s client returned one of the buses and then demanded over $80,000 in unpaid invoices for the operation of the buses before returning the second one. While the parties were negotiating their dispute, the remaining coach bus was repossessed by the lien holder for lack of payment. The plaintiff blamed the repossession of the bus on Ayala’s client’s “delay “in returning the bus.

The plaintiff, without doing the bare minimum due diligence, alleged claims of “theft” of not one, but both buses.

As stated by attorney Eduardo A. Maura, “We are very happy with the result. At the end of the day, we were going to spend more than $10,000 in legal fees to defend this case at trial. While our client’s shouldn’t have paid a dollar for these claims, we see some of these settlements as business decisions from our clients which we fully support.”
