We’re thrilled to announce that we have secured a full defense verdict in a case involving a $3 million land dispute in Miami. In this family land dispute, one sibling claimed entitlement to the land based on his investment in the family company that purchased it.
At trial, our client provided evidence showing that the initial investment for purchasing the land came from family funds in Peru, not from the plaintiff. The plaintiff had transferred the money from his personal account just three days before the purchase, after receiving it from the familyโs business account.
Our client presented evidence showing that in 2019, the family decided to transfer the company’s shares (and the land) to the defendant as repayment for shares in the Peruvian company that had previously been taken from him. The plaintiff failed to acknowledge this transfer despite having signed off on it. Ultimately, the jury unanimously agreed with our client’s position.
As attorney Eduardo A. Maura, Esq. stated, โWe are extremely pleased with the verdict. The jury clearly understood the true nature of the situation. My client did not seek unfair enrichment; this was a family matter where the four siblings collectively decided to transfer the land to our client. The plaintiff’s later change of heart due to unrelated circumstances does not invalidate that decision.โEduardo continues, โI am also proud of our team and of my partner Ryan Sawal, Esq. for all the hard work during this trial. Jury trials are a lot of work and sleepless nights. Coming out with this victory makes it all worthwhile.โ
